    Shame on the 111th Congress and President Obama for not codifying R v W when they had a supermajority window. Makes you wonder if it didn’t happen because the threat of this is a way to get people voting. This may have been covered earlier not reading 28 pages.

    Much more of a shame that in 2022 old out of touch men want to tell women what to do with their bodies.

    You probably don't have that right, so a state can take it away (though it seems unlikely they would). I have never researched the state of laws against masturbation in late 18th century England and the colonies, but it seems the kind of thing they may have outlawed along with adultery, premarital sex, sodomy, etc.
    Outside of meat specifically (which could theoretically be banned), these would fall under the right to life, since you cannot be alive without eating, breathing, pissing, and crapping. You also have the right to be secure in your person against unreasonable seizure, which prevents the government from restraining your movements willy nilly.
    As I said, I don't think masturbation is a constitutional right. The rest are addressed in the Constitution, just slightly more broadly than the granularity you have suggested.
    Except that it isn't. The logic for the right to life is the government is specifically forbidden from taking your life absent due process. All of these were also already protected under the law at the time of the founding. Abortion was not. The 9th and 10th amendments make clear that not all rights need be specifically listed in the Constitution in order to be protected rights, and those that were not were reserved to the states or to the people. How then do we decide what these unenumerated rights were. We look to what was protected before the Constitution was written. What we can be pretty sure were not rights reserved to the people are things which were illegal at the time the Constitution was written or made illegal when the people involved in drafting the Constitution were still around to comment on it. The right of women to vote, for example, was not protected by the 9th and 10th Amendments. That's why they didn't have the vote until the ratification of the 19th Amendment. Was abortion a protected right in 1789? No, it wasn't. There were already laws against abortion in the English common law. Codification of laws against abortion followed soon after in 1803 in England (punishable by death after "quickening" but still criminalized before) and in the 1800s in the United States (while the founders were still kicking around). Don't you think Madison would have noticed that abortion laws were being passed and said something about it, maybe when he was President of the United States? Did they all just miss it for over a hundred years and then suddenly everyone realized in 1973, oops, we accidentally have been infringing on this well established Constitutionally protected right for over a century.
    Of course you can, if the child is about to kill you, you can kill it in self-defense. Self-defense is a key principal of libertarianism.

    A bunch of old men are upset that the central authoritarians are leaving the decision to allow women to make choices to the individual states.

    I always laugh at this bullshit phrasing, treating white women like a giant voting bloc.

    Guess what, half the voters in MAGA states are women. Guess what, they vote like their husbands , fathers, sons ,who tend to be white men. An environmental justice advocate in Portland is not going to vote the same way as a home schooling teacher in Jacksonville. Even if they're both white women!

    The same phenomenon exists in men. I don't think either white women or men (or black Hispanic asian) should get a free pass or more blame for trying to affirmatively destroy the country and install a fascist regime - they're equally to blame in terms of voting. You can make a moral argument that those with lower information are less morally culpable, but ultimately they're all doing the same bad thing.

    But at the end of the day, regardless of demographics, Clarence and Ginni Thomas are both arsonists of democracy.

    Imagine believing basic rights in a nation should be left to individual states. For me "states rights" should be about allocating resources where the states have a better idea of what resources are needed.

    States rights should delve into individual liberties. We shouldn't in the same nation for example have gay marriage legal in one state and illegal in another state. US citizens should all have the same civil liberties across the nation. It's such a stupid premise to delegate civil liberties to states.

    Human rights should be the same in Kentucky and Massachusetts.

    Will it be enough against MAGA hordes of QAnon nutjobs, retirees etc? Jim Crow Voting restrictions? Gerrymandering? Rural electoral bias in our constitution? The Senate's centuries of existence as the strangler of self-determination? ****head Trump Judges with a thumb on the scale? Corrupt state and local dictators and apparatchiks like DeSantis-Pushaw-Abbott-Patrick? Broken media ecosystem that both sides the fascists and terrorists etc? Zuck's poison spreading machine?

    Maybe not!

    Our pre- and post- assessment of horse race tactics and strategies makes for compelling reading. But the reality is our institutions and constitutional system are inherently broken which is why the GOPutinist shitheads are even in the conversation.

    Given how few Republicans appear to be celebrating the content of the draft but instead raging about that it was leaked shows that they know this will be unpopular. I'm pretty sure for Mitch McConnell even while he is against abortion this is a headache for him that complicates taking back Congress. My guess is he will do all he can this fall to tamp down any talk of a national abortion ban in the Senate.

    The upcoming bounty hunter and fugitive slave type laws to prevent interstate abortions, the attempts to extradite blue staters who provide reproductive health care to stand trial for murder in the deep south, jailing rape victims for child abuse,

    All of this handmaid's tale **** is coming to a state legislature near you and Moscow Mitch can't do **** all about it

    Wasn't it inevitable? The opinion isnt surprising given the make up of the court. RBG shouldve retired in her early 80s. The leak should piss everyone off, especially the actual court. It seems that the administration has dismissed the leak. And honestly, the penalties dont seem that harsh so maybe there is somewhat of an overreaction to the leak.

    All things not explicitly stated in the constitution belong to the states. I didnt make the rules. Nor do I want to debate the nuances.

    In a country as wealthy (intelligent, technology, resources, ect...) as the USA, we should not have such a large population of people living in poverty. The fact of the matter is that as a person moves up in the socio-economic ladder, the less they care about doing something about social issues outside of getting up on their soap box and telling everyone how we should run the country. Everyone is a good-idea fairy.

    There is no good solution. But abortion and transgender nonsense is pretty low on my list.

    Has Tim Ryan advocated overturning the current laws which already restrict late term abortions? There are already restrictions on late term abortions. If he advocated removing any and all restrictions it might make sense. I haven't seen that though.
