[Politico] Supreme Court has voted to overturn abortion rights, draft opinion shows

I'm against abortions after the point the child is viable outside the womb. This is roughly around 22 weeks for a normal fetus. If there is a medical condition that would change viability, then I'm good with extending it.

In any case, I am sure conservatives can celebrate this victory over women but all this does is create a black market for women self-inducing miscarriages. The question will become whether states prosecute and imprison women for doing that.

You referenced my comment I made about no one giving a **** regarding Biden's positions 40 years ago. I don't get why you are trying to connect it to RGB! I think her opinions on abortion are highly important even 30 years ago. Why on earth would I say no one gives a **** about RGB's opinions?

These are good points, and yes, I'm very aware that Justices twist or cherry pick history to back claims when ultimately, a constitutionality of an issue is gray and a lot comes down to preference. All those concerns you have about states going backwards - I'm not arguing that it will or will not happen. The point I'm making is that I think many Americans fail to recognize that many rights that people have today were interpreted or created by the courts. The right to raise your kids is created by courts, as is the right to have kids, as is the right to an abortion (which will soon change). There are numerous.

Through this method, without getting lost in the weeds of how it happens, a lot is really just Supreme Court Justices expressing their opinions on what is right or wrong, what is moral or immoral, and what is legal or illegal. There are factors that go into this such as theories of interpretation, constitutional connections, even presidential pressure. Cases can connect or each case can have individual factors. From a ConLaw standpoint, none of these rights are 100% clearly protected by the Constitution, but at the same time, the Constitution specifically says there are numerous rights that people retain that don't have to be clearly listed. How nuts is that! I love teaching the self-contradicting ridiculousness non-sovereign defining US Constitution. It's absurd and wonderful at the same time.

But when you decry state level moral legislation that takes us backwards. I ask you, why are the courts the only savior in our system? There is a democratic political process. In fact, the courts are there to step in when the process fails to function. A better argument can be made imo for courts to stop gerrymandering, though they currently refuse. We, the people, in a functioning democracy, can impact state government via voting. And as bad as gerrymandering is....As bad as racially biased policies are....the biggest factor is that Americans and even moreso Texans, don't vote in state elections. It's terrible. Did you know we are voting Right Now on amending the Texas Constitution regarding property taxes? It's like a 10% participation rate.

Anyhow, somebody is going to make a moral decision this issue is debating a woman's rights vs people's differing beliefs in the rights of the unborn. Some think they have none. Some think they have a lot. Because here, judges are washing their hands from it and saying it's up to the people now. Obviously, conservative judges are happy because many state legislatures are dominated by hardcore conservatives. But that's not written in stone. And they got there from people voting for them.
