New York Supreme Court Judge David B. Cohen has now ruled that voting-machine company Smartmatic’s $2.7 billion defamation lawsuit against Fox News and Rudolph W. Giuliani can proceed. The case involved numerous false and baseless claims made on Fox about voter fraud involving the company’s voting machines.

The ruling repeatedly says Fox hosts, Giuliani and Powell made claims “without any evidence” and “without any basis.” It also says that claims made by Giuliani, Fox host Maria Bartiromo and now-former Fox Business host Lou Dobbs could meet the legal standard of claims being “so inherently improbable that only a reckless person would have put [them] in circulation.”

“Even assuming that Fox News did not intentionally allow this false narrative to be broadcasted, there is a substantial basis for plaintiffs’ claim that, at a minimum, Fox News turned a blind eye to a litany of outrageous claims about plaintiffs, unprecedented in the history of American elections, so inherently improbable that it evinced a reckless disregard for the truth,” Cohen wrote.

The organizing call talked about here is with Women for America First. And while they were at the rally, I also don't think that's an organization of particular interest for the violence of Jan 6. The whistleblower (who worked for WAF in what sounds like a low level capacity) said they discussed with Meadows whether or not to get a permit for their march but didn't want to because they'd have to pay for security and because it'd make for bad optics for the president. It looks like one little data point and not really as meaningful alone as the tweets make it sound. Trump wanted a big presence in front of the Capitol for Jan 6 - we already knew that. If they were coordinating with the Three Percenters or Proud Boys to break into the Capitol, that'd be something, but that's not what we have here.

 

I guess there is still much to uncover (since part of the evidence comes from cell phone calls between meadows and organizers that meadows tried to block release of).

Part of the story is also the lies about what participation if any. For example, Pierson claimed so such call happened. And the use of so-called "burner phones" suggesting advance awareness of illegal activities. This investigation should continue to determine what happened (in order to exonerate those with didn't plan or promote the insurrection or identify and convict those that did.
