Abuse of NDA to suppress free speech. NDA in the WH is as ridiculous. "The Campaign’s past efforts to enforce the non-disclosure and non-disparagement provisions demonstrate that it is not operating in good faith to protect what it has identified as legitimate interests,” the judge added. “The evidence before the Court instead demonstrates that the Campaign has repeatedly sought to enforce the non-disclosure and non-disparagement provisions to suppress speech that it finds detrimental to its interests." “From our perspective, it’s really not about politics,” Langford said. “No one should have to give up their free speech rights or swear allegiance to a candidate forever just to get a job with or volunteer on a campaign.” Court voids Trump campaign's non-disclosure agreement - POLITICO
For all of the handwringing about unpopular Dr. Suess titles and Pepe LePew. I'm seeing very little concern about the Trump campaign and Trump Organization use of NDA's to suppress speech. Further I see very little concern about the Trump Administration destroying Presidential records and not turning over material per the Presidential Records Act. If we're talking about preserving content that is important society such material will be very important.
I posted that Trump republican has done a 180 and @Os Trigonum thought it was the other way around. Whatever it is, what we have that would not sit pretty with real Republicans are, to name a few 1- Freedom of speech suppressed by gov. Public employees were forced to forever secrecy to a President and Republicans were fine with it. 2- Right of companies no more. Dr. Suess Enterprise shouldn't be allowed to remove titles, said Republicans. 3- Bad behaviors are fine. Republicans accepted and allowed Trump horrible bad ethical behaviors. Obviously, the danger of free speed has always been suppression of it by the Gov and here we had a President doing it. And, of course, we would want to hold our elected official to the highest standard, not the lowest possible standard. Trump's lawyer is considering an appeal but now with the NDAs struck down, public employees can voice what they saw and heard. We might see some tell-all books and if so, we will see them labeled as fake if not first suppressed by Trump's lawyers from publishing. Now that Trump is no longer president, a federal court has also allowed a defamation/sexual-assault lawsuit to proceed. He could now face deposition under oath about sexual assault accusation. Finally we'll get some real tell all books that provide a detailed look at the Trump administration from a low level staffer prospective.
The last sentence of that article is underrated comedy ... The Trump campaign asked judge Gardephe to edit the provisions if he found them unenforceable as written, but he declined. lulz ... I can’t imagine the audacity to say that to a federal judge. Basically, “well, if you don’t like it, let’s see you do better.” What? Were they trying to coax him into putting an enforceable version into the legal record, or just trying to insult him. Or simply, “hey judge, can you write our contract for us, for free.”
I agree in principle but the judge basically said the terms of the nda are nuts because of the forever provision. He's not striking down narrower NDAs or disclosures in polling data or trade secrets. NDAs are essentially contracts between two willing parties for a set duration. It shouldn't be a blood oath to perpetual bondage but maybe that's a territory deFi smart contacts and NFTs can break into
...when the emperor doesn't have on any clothes, the last thing he wants to see from anybody is a blanket.
True these are contracts but so are Terms of Service Agreements that people agree to access social media. What we're hearing from these sudden defenders of free speech is that those contracts shouldn't apply when social media takes down posts that are found to violate those terms.
Also this: "so vague that the agreement was invalid under New York contract law" Trump's NDAs reflect a common trait of him - The art of vagueness, so that he can claim from nothing to everything, whatever serves him in the moment.
