Yes, it's a part of his article. It's a really good read... makes a compelling argument that mandatory OJ shouldn't exist, even though in my opinion, textually it may seem like there's a lack of discretion there. Doing so would for all practical purposes ruin the original intent of the court to be an appeals court by flooding it with endless meritless OJ. This Paxton suit just so happens to be the worst extreme example of how a state could abuse a court that accepts the view of mandatory OJ, so even Thomas and Alito may have to change their thinking moving forward. Pretty cool huh? In a normal world, Thomas and Alito can just keep pushing their interpretation along, be the dissenters, and say the rest of you Justices are doing it wrong. Now, they face the terrible choice of having to vote to hear this meritless dumbass lawsuit that would open pandora's box of endless dumbass lawsuits, or turn around and say, oh yeah, our jurisprudence is wrong. Thanks Paxton for making conservative justices try to defend the indefensible.
trump is either uniformed about presidential history or just a complete liar (insert girl saying "why not both" meme).
Why are you blaming republicans? They will do what ever they have license to. Dems don’t take counter measures which is why they are a party of pussoes
https://www.tmz.com/2020/12/10/kim-kardashian-west-brandon-bernard-execution-victim-family-talks/ Donald Trump stopped taking her calls....
Republicans have power and have become corrupted in the last 4 years, not sure what Dems could have done to prevent them from becoming fascists. What counter measures did the Dems have the ability to enact?
You can’t continually be on the defense. Trump is doing overt treason. Counter suits. Flood the coirts
If we want to avoid stuff like this happening again there should be consequences. Politically most of the Representatives are from safe seats but there should be an all out effort in 2022 to defeat Paxton, if he isn't prosecuted before then. States should be looking at counter suits to recover costs they have spent defending from these unsubstantial suits. People giving testimony not supported by fact or signing false affidavits should be prosecuted and lawyers pushing lawsuits with no basis in law or fact should be disbarred. None of this will be easy and will be divisive but just allowing the country to be dragged down is already damaging the country and there will be a big temptation to do this again if not addressed.
start with the head down suit/charge/investigate the hell out Trump and his family covid fart, karaken & assoc Turtle, Cruz, etc... then Paxton other AGs and congressmen who supported him, the rest of the GOP senators and governors who kept quiet..
Correct... giving these hyperpartisan frivolous lawsuits a pass will simply encourage more and worse frivolous lawsuits by the losing party.
considering Hillary lost the electoral college the same as LossBaby lost while getting more votes, how may law suits did the dems file?
is "legacy media" a thing? I haven't kept up with the batshit nutballs' latest gloss for eroding any notion of objective truth.
