He had no immediate safe haven and the fact he was being pursued gave him the standing to ultimately have the necessity to resolve to legitimate self defense. Kyle, was not of age and for that he is liable but then that doesn’t override a persons right to preserve his own life and because he attempted to evade but there was no way he could reach the safety of the officers in time and was pursued, once a confrontation was inevitable he has authority of preserving his life
Perhaps not if you just shot someone in the face and certainly not if you weren’t aware the person had a weapon. Did he know? I doubt it and we’ll never know now because all the details came out after he was allowed to escape arrest on the scene. Which murder do we want to apply that consistent standard to though? There were three different people shot. One was armed with a plastic bag. The guy in the Denver incident had already been assaulted and was being approached a second time. Let’s be consistent in the application of lethal self-defense. You all want to have it every which way.
