Could the suspect carry the rifle legally? Kyle Rittenhouse, a 17-year-old militia member who has been arrested and is facing a homicide charge in the matter, was not old enough to legally carry the assault-style rifle he had, according to statutes, which say anyone under 18 who "goes armed" with any deadly weapon is guilty of a Class A misdemeanor. John Monroe, a lawyer who specializes in gun rights cases, believes an exception for rifles and shotguns, intended to allow people age 16 and 17 to hunt, could apply. He could be in violation of having a gun within a gun-free zone, if there was, for instance, a school nearby. Also, Illinois law requires anyone who owns any kind of firearm in that state to have a Firearm Owners Identification card, but that is only available to someone 21 or older, or someone with a sponsor who is 21 and eligible for a card https://www.jsonline.com/story/news/crime/2020/08/26/wisconsin-open-carry-law-kyle-rittenhouse-legally-have-gun-kenosha-protest-shooting-17-year-old/3444231001 Class A Misdemeanors Class A misdemeanors, the most serious misdemeanor crimes in Wisconsin, are punishable by up to 9 months in jail, a fine of up to $10,000, or both jail and a fine. Theft of property worth less than $2,500 is a Class A misdemeanor. (Wis. Stat. § 939.51 (2019).) So by the definition above you have a case for Involuntary Manslaughter. Involuntary Manslaughter Involuntary manslaughter is defined as an unintentional killing that results either from criminal negligence or the commission of a low-level criminal act such as a misdemeanor. Involuntary manslaughter is distinguished from other forms of homicide because it does not require deliberation or premeditation, or intent. Because neither of these mental states is required, involuntary manslaughter is the lowest level category of homicide.
more than that would depend on the testimony of 'credible' eyewitnesses so they will have to wait for the investigation conclusions. I think if I were the prosecutor I would have to have my witness unaligned with either side, their bias would be challenged on cross examination.
So what about citizens arrest since that was all the rage in Arbury case? The crowd was was trying to detain him because he shot a guy in the head, how does the initial criminal act now afford him self defense?
They charged him because he had just shot a guy in the head, any other circumstance you would be calling them heroes because they were trying to apprehend a murderer. Its funny how things change, you had everybody and their Mother claiming that the people who shot Arbury had the right to detain but now this guy who actually committed a crime is somehow in the right from being detained? I guess you believe that if Arbury had a gun he could have shot everybody who was chasing him?
Maybe the first guy that got shot should have not chased his eventual death dealer to start with along with throwing a object and even saying “shoot me n word” before all of this had started ...this was caught on video of the first shooting. It’s his actions that led to him getting shot.
There were posters here who were pretty confident the McMichaels would be justified in their murder of Arbery as self-defense. There is some kind of reflex with some posters to pick their side and then find rationalizations.
Maybe a juvenile shouldn't have driven to civil disorder with a semi-automatic rifle. Anybody got the story of the kid's parents?
The only thing you need to stop a bad guy with a gun who shot 3 kiling 2, is a good guy with a gun, and the police to let him walk away free and then arrest him the next day without incident.
Maybe the 17 year old should not have been cosplaying GI Joe across state lines, maybe the was chasing him because he was pointing a loaded weapon at people and he was trying to protect other protesters? You actually think he was justified to shoot an unarmed man in the head because he was coming at him? The 17 year old kid was the criminal in this situation he never should have had the gun there in the 1st place. Do you know if the kid instigated all of this by pointing his weapon at people?
