You're from Germany right? Don't get me wrong but if that's the case I wish Americans were as informed as you are. Maybe I'm thinking of @AroundTheWorld
I'm so ready to pack the courts and make those 50 yr old F Society ****ers squirm. Even an Ivy League grad couldn't write up Clarence Thomas as a role because it's so unbelievable. Filibuster what? Let's call a spade a spade and just admit it was a racist weapon that became abused by both sides after landmark 70s legislation. It's not even in the ****ing Constitution. These delay tactics are why SCOTUS is "legislating" and POTUS creates the Executive Orders in the first place! Even the Fed is now "emphatically insisting" Congress to do more to tackle real economic issues. I didn't even know DACA was an Executive Order until the recent decision. Citizens United ruling explicitly said, if you don't like the ruling, legislate new laws to deal with it. Are we ready for that yet???? Oh yeah, the pendulum will swing hard on the other side. But I'm guessing the land owners and oligarchs will tremble just as much when Cleetus takes over and probably do more to educate them correctly than toss a $1,200 bone every now and then.
I'm not for packing the court. This is one of those ideas that we see liberals trot out when conservatives are in charge forgetting that this could go the other way. Trump himself brought up packing the courts and if he wins reelection and the Senate stays in Republican hands I wouldn't put it beyond him to do it because of his pic over the DACA ruling. That would push the court even further into conservative hands.
The whole supreme Court needs to go. Let just have each party just pack the courts so we can change it. 9 old ass people have lifetime appointments who pull **** out of their ass isn't good for America. For every brown vs board we have a dread Scott case
How about less drastic changes... higher minimum ages, term limits? If the reason behind the current court is to "prevent politicization" of the court, it obviously failed miserably and that failure is most evident now. Seems a more accessible churn will limit the impact of any one single hyperpartisan selection.
Packing the Court is a terrible idea. It is no different that what the Trump administration has done eroding the checks and balances. FDR proposed doing it and was shot down by his own party. We are not a Banana Republic. Play by the rules... besides if the Democrats hold onto the House and take or nearly take the Senate...... Biden would likely get to replace at least Breyer and RBG with younger nominees........ but if you statistically look at the ages of Thomas, Alito etc...... he may get to replace a conservative and take control of the court.
Who would have thunk that kavanaugh would be both anti personal liberties and pro corporate protection?
gym jordan often gets confused when it doesn't involve staying quiet while young men are getting molested in locker rooms...
Dems are better off trying to pack the Senate (DC Statehood and potentially Puerto Rico statehood if there is enough support in the November referendum). Messing with the courts is a dangerous play and Roberts's temporary shift to the left has basically killed all momentum for now. Now if Roberts had ruled the other way on all of these cases, I'm fairly sure that court packing becomes a viable idea. But that's all off the table now. Roberts strategically voted and cut off any path to court packing.
Stacking the court with judges from your side of the aisle is wrong. But we need some change to the current process of appointment to the Supreme Court - it has become unbearably political and erodes trust in the institution itself. is one way to depoliticize the process and increase the number of judges on the court
McConnell packed the court in his favor already. As currently constituted, the USSC can be manipulated by the Senate. A Republican controlled Senate going forward as a precedent will never again have an up/down down on a Democratic President's USSC candidate. Redressing this will also be packing the court. Here is a fix https://newrepublic.com/article/154047/better-way-fix-supreme-court Buttigieg told NBC News that he favors one of the plans outlined by law professors Dan Epps and Ganesh Sitaraman in a forthcoming Yale Law Review article. If implemented, the so-called Balanced Bench plan would expand the Supreme Court to 15 justices. Ten would be chosen the normal way, but with a twist: Five of those justices would be “affiliated with” the Republican Party, while another five justices would be affiliated with the Democratic Party. The other five justices would be chosen not by the president and the Senate, but by the unanimous agreement of the other ten justices on the court. What’s more, they would only serve nonrenewable one-year terms after being chosen two years in advance (to avoid the selection of justices to weigh in on specific cases). Though the reformed Supreme Court would ostensibly have 15 justices, in practical terms it would have ten full-time justices and the five most powerful interns on the planet. What happens if they can’t figure out who to appoint? In a word, nothing. The court “would lack a quorum and could not hear any cases for that year,” Epps and Sitaraman explained.
So speaking of packing the court and packing the Senate...is that the way we work now? If your guy isn't in, just change the rules? Seems super slimy. Every time you "change the rules" you have a bunch of unintended consequences...namely, as soon as your party loses control, you get a taste of your own medicine. How could any Dem be angry at the current iteration of the Supreme Court? They've ruled positively on Dem causes multiple times recently. The court is full of textualists and consititionalists. Its basically working correctly and quite frankly, has been working in a very centrist and measured way.
That is the way the Trump administration has worked..... but no, we don't need to go down that path as it will just lead to ruin. Having said that, I do think we are headed down that path in general. Most of the concern with the Supreme Court is one party having a super majority which would happen if Trump were re-elected.
