This should be an easy case that the Constitution grants Congress powers of oversight and that a law clearly states that the Congress has subpoena powers. After Bush v Gore who knows... Also it wouldn't surprise me if a ruling was delayed until after the election. Roberts doesn't like a lot of attention on the court and no matter what the ruling is he would probably not want it to affect the election.
