So regardless of why the jogger was in the house under construction, regardless of whether he had prior convictions, regardless of the skin color of the people involved - clearly the jogger had not committed a felony immediately leading up to the confrontation. So there was no actual reason to cut him off and threaten him with guns. Even assuming that the men doing so had no racist intentions and believed there was a reason to confront the person - objectively, they would have been wrong.

Therefore, they were the aggressors and not acting lawfully, no matter what they subjectively believed.

The jogger had a right to defend himself (although it was a very bad idea - it would have been much better to just put the hands up in the air).

They initiated the confrontation, then shot someone who had not been confronted in the act of committing a crime, but was defending himself when unlawfully confronted.

I don't see how anyone could argue that they should not be convicted.

At best, their mistaken belief (if one believes that was the case) that they were confronting someone who had just committed a burglary could be seen as a mitigating factor.

 

Yes. I don't think their intent was to kill him so that means they shouldn't prosecute them for murder 1 or 2. This is a well deserved man slaughter charge. They were being reckless while commiting an illegal act that resulted in a death.

 

Plus, he was leaving the neighborhood....didn't have any contraband....didn't have any weapons....wasn't a physical threat to anyone.
