    This is likely what the defense will argue. I believe their argument is weak as hell based on the facts we currently know. That could change though if more information comes out.

    "George Barnhill, one of the prosecutors who first handled the case, defended the actions of the McMichaels and their neighbor in the truck. In a letter to the Glynn County Police Department obtained by NBC News, Barnhill wrote that the men had "solid first hand probable cause" to chase Arbery, a "burglary suspect," and stop him.

    Barnhill also said that after he watched the video of the incident, "given the fact Arbery initiated the fight" and grabbed the shotgun, he believed Travis McMichael "was allowed to use deadly force to protect himself" under Georgia law."

    Do we all agree that the McMichaels only saw him running down and not on the property so if he was just a jogger does not matter?

    So if a person grapples for the weapon of a guy trying to rob him and they are killed it doesn't matter?

    Since we are playing hypotheticals maybe Arbery thought they were trying to rob him or kidnap him.:rolleyes:

    According to the law it very much does matter.

    Also, "dude grappled for a weapon" does not absolve the defendants of any wrongdoing or responsibility for the outcome. Quite the opposite, in fact.

    What you're going to discover is that if Arbery had killed either of the men who chased him down in a truck and accosted him with guns he would be perfectly within his rights to do so because they are going to be considered the assailants by the court.
