25 year old man murdered in Georgia for jogging while black

    This is what you said that I find fault with. It was not a bad ruling by the jury - it was correct. I am not sure why you made this statement.

    Since looking for trouble isn't a crime, why do you keep bringing it up? A) it doesn't have much legal significance and B) it's not something that can be proved. I am not sure why you are hanging this case on that because I am pretty sure they will fail if they take that road.

    The case should not be able whether or not the McMichaels were "looking for trouble" or not. It should be whether or not they took reckless action that lead to someone's death. That's where they can win the case. Stay away from what's going on inside their head and focus on whether or not their actions were reasonable - which they were not.

    OK, this piece above is where many people disagree. The McMichaels were attempting to detain a person they honestly believed to have been involved in a burglary. Arbery fit the description of the man seen on the video and a 911 call was placed raising the prospect of a crime. If anyone is going to detain a burglary suspect, it would be wise to be armed. They didn't know if Arbery was armed or not, and even if not, he's a dangerous opponent just with his youth/fitness/fists. The McMichaels attempted to stop Arbery and prior to being rushed by him, did not use their weapons at all, despite having multiple potential opportunities to shoot him first. It was only AFTER Arbery initiated the struggle by trying to wrestle the gun away from them, when they shot him. And McMichael didn't shoot Arbery until he was being punched by Arbery. At that point, you have no choice.

    Bad situation all around, but I think the McMichaels acted to protect the community, and things just took a bad break after Arbery rushed them. Without Arbery's attack on them, I think the situation could have been diffused until the police arrived - which was likely McMichael's goal - detain/impede until the police arrive.

    Put yourself in the McMichaels' shoes - if a burglary suspect goes for your gun and punches you - how should you handle that?

    The problem with your logic is that based on it, anyone can detain anyone under the pretext they believe they are a criminal. I could detain you by simply saying I honestly believed you had fit the description of a criminal. And if you resist, I can shoot you in self defense.

    As must as you would like to believe this is how the law works, it does not.

    Now, what Arbery should have done is brought a gun with him, and as soon as those guys appeared, he should have shot them in self defense because they looked like criminals about to harm him.

    This is the world you want to create.

    Ok, well at least thank you for a reasonable response here. This represents progress in this thread.

    The pretext I'm relying on here is the video, the 9-11 call, and the belief that Arbery was the burglary suspect. That's more than significant justification to detain him. To turn your logic in the opposite direction, you could never apprehend a burglary suspect unless you had proven the case already beforehand. That's not realistic at all.

    Additionally, he did far more than resist. He punched McMichael and attempted to wrestle the gun away. Those actions alone led to the shooting. They weren't going to shoot him up until their lives were threatened.

    The root cause has always been poverty that resulted from 400 years of systemic racism. So your solution is solving poverty. Are suburban black engineers involved in gangs?

    This is open and shut manslaughter. This is a perfect good faith interpretation of man slaughter

    Let's review the basic facts.

    1. Georgia statute dictates the only legal justification for citizen's arrest is physically witnessing a felony and immediately detaining. You can't even witnesses felony and decide one week later to hunt down and detained the man.

    2. Even in the most friendly interpretation of what they did which would be setting up a road block with firearms waiting for him instead of chasing him with a truck, the intent was a citizen's arrest which from Georgia statue means they had no legal justification which means they were performing an illegal act.

    3. An illegal act such as detaining a citizen without justification or driving intoxicated that leads to the accidental death of another individual is a text book example of man slaughter.

    People say the shooters could legitimately make a “citizens arrest” because they believed Mr Arbery fit the descriptions of someone who committed a prior crime but blame Mr Arbery for punching one of the gunmen. Have you considered maybe Mr Arbery was attempting to make a citizens arrest for what he believed to be a criminal intending on committing murder?

    Another example of how this case has already been tried in the court of public opinion. Incomplete facts aside, many people have already made up their minds on this, and will never be persuaded otherwise. They will even use it as grounds for another racial pity party, like they did with Trayvon. Hopefully they won’t end up killing more people and committing far worse acts of violence like last time (rip officers Liu and Ramos of the NYPD).

    This new evidence suggests Maud may have been up to no good, and partially explains why he acted so aggressively against the men who appeared to be trying to keep their neighborhood safe.

    And if you detain someone using deadly force or want to use a gun to detain someone and they die then you are playing with the big boys and thats murder.

    if they die while you are detaining them you have murdered someone. If done in broad daylight and on video like this and clear race differences you will also need to face the reality of an additional charge of hate crime. Not all jogs or murders are hate crimes but if and when applicable it should apply. As a juror I would say it does here and besides the reckless firearm charge, there would be murder ( in moment not altogether premeditated but murder beyond reasonable doubt)
    With the additional hate crime plus murder they would be eligible for death penalty and would likely give them life no parole or the shooter life and the other a long sentence without freedom until 2050 at earliest.

    Perhaps unlucky for the murderers it was on tape and especially gruesome.

    This is not 1863 new mexico and not sure what type of america you want to get to? If you are going to detain you cannot use deadly force. Mix in some bear mace like dog bounty hunter does.

    These guys are not judges and you cannot go around detaining people in united states of america. This is the kind of stuff that was settled in wars and our laws amendments and constitution.

    Lets talk about real gun laws and what it takes to own a gun and where we have landed in 2020.

    Open carry is one thing but you cant tell me these guys weren't using the weapons recklessly waving it around and brandish. Thats a felony to begin with.
    And you are allowed to run down the road in usa.

    Not sure rules in your country?

    Yes so the solution is solving poverty. So all those threads about black urban poverty, improving income inequality, health insurance coverage, education etc. Those are there threads you are looking for but unfortunately they aren't framed in a way that chastise black people so you don't count them as genuine discussions. It just seems like you want to be on a high horse.

    Leading the country in Murder. . .. . and leading the country in murder convictions are not the same thing.
    How many crimes . . .like this one. . . .were covered up and pled down ?

    Georgia Code Title 17. Criminal Procedure § 17-4-60
    A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.

    "Within his immediate knowledge" opens up some gray area and will be exploited by the defense team.


    Why these 2 idiots decided to confront him instead of just staying back and following him until the police arrive is beyond me. You are in a truck... he is on foot in the middle of the road. Stop trying to play cops and robbers.
