Why can’t a Muslim who looks Indian claim that their family has been living in India for generations? You just said that the law doesn’t require evidence/proof, so what would allow such a person to be deported? If you’re saying there is a double standard in accepting the word of a non-Muslim but not a Muslim, then THAT is the problem.
Because the law doesn't apply to Muslims. The right isn't granted to them. Illegal Muslims don't have a citizenship right so they will have to be deported.
The law grants citizenship to any person who is born to Indian citizens in India, and anyone born in India before a certain date is automatically an Indian citizen. That’s the law. So, again, what prevents a Muslim from claiming, without evidence, that law applies to them based on their ancestry?
Why is this the hill you want to die on? Seriously? This has been fleshed out for you barney style and you still have trouble understanding how this bill can be abused. If the exception is for pretty much every major religions except Muslim, then if a Muslim family who doesn't have documentation who was born and raised in India like millions of Indian residents who also don't have paper work, then a leader with bad intent as a Hindu Nationalist can easily abuse it and have legal authority to do so. And due to the segregated nature of how Muslims and Hindus lie in separate regions and villages, it hard for a Muslim family to lie they aren't Muslim as it's obvious when a small village is Muslim or Hindu.
Because they won't have proof. You seem to misunderstand how law works. The way laws are interpreted is subjective and ultimately will be defined when they are challenged in the court system. The law just passed gives coverage for the gov't to sweep up Muslims while leaving Hindus and other groups untouched. If someone is a Hindu they will leave them alone. If someone is a Muslim, they will need to show papers and when they can not produce they will be deported. It really is that simple.
Yup the law basically creates a situation where only Muslims are asked to show proof or "papers please".
So the law says that they need proof if they are Muslim and they don’t need proof if they aren’t Muslim? Please point out where the law says this.
Maybe that’s what ends up happening. We are agreed that would be unjust. I don’t think it would be justified based on the letter of the law. There’s no point in us continuing to argue about it. We will see if what you are describing (deportation of undocumented Muslims who claim to have legal status based on birth) actually comes to pass.
https://www.vox.com/future-perfect/2019/9/17/20861427/india-assam-citizenship-muslim-detention-camps It most definitely will come to pass
The problem is that the law DOESN'T specify. That's the part of the issue with the law and intentional to allow for abuse.
Thanks for the link. This is the key part, to me: “Meenakshi Ganguly, South Asia director at Human Rights Watch, told me. She noted there are concerns that the Foreigners’ Tribunals may well go easier on Hindus than on Muslims who appeal their citizenship determination. Some lawmakers are pushing a Citizenship Amendment Bill, which would carve out exceptions for immigrant Hindus, Sikhs, Buddhists, Jains, Parsis, and Christians — but not Muslims — left off the NRC.” There need to be policies in place to ensure Muslims and non-Muslims who are left off the registry are treated the same during appeals when they are claiming legal status based on birth.
You don't like? Is that what you call illegal immigrants living in your house? Or maybe you run a business / corporation with employees who come and go as they please? No documents required? How can you govern a business, family or country like this? You cannot, that is a fact. Much like Balsonaro in Brazil, Farage in the UK , trump etc. etc., the trend we see with nationalism has a lot more to do with economic opportunity than any narrative you want to believe. There's always a spike and then reality sets in when you realize not everyone can have the lifestyle the media markets in a global marketplace. People are angry and frustrated and think nationalism is the answer.
