Signed my dad for car insurance, he gets into a wreck a week later.

    Your original post is unclear and vague. It just basically seems like you cancelled the insurance and they are still billing you. The accident has no bearing on this issue about payments.

    So if that is accurate, what does the insurance agent say when you ask them about canceling?

    When you gave them the card info, that's the card they have on file to bill monthly. Its not their fault, it your or your dads fault for not updating it to a different form of payment. They don't send you monthly bills to pay on a month to month plan. Contract or not, that's what they did to bill you. The insurance policy IS the contract between you and Allstate.

    You need to call and cancel the insurance policy immediately. The last few months are probably lost as you did technically pay for services rendered even if the car was totaled. They maybe able to refund you if you can prove that it was totaled during that time.

    Chalk this up as a life lesson to
    1. never provide your payment info for others, not even family members.
    2. a lesson in common sense and adulting

    Agree with @BleedsRocketRed. Your father entered a contract over the phone, and the company recorded his agreement. So they have a contract. I would cancel now to avoid further payments and then ask them if you can get a refund for the payments since the accident because obviously the car wasn't being driven anymore. They might give you something -- customer support at some companies are given permission to hand out a little candy for the sake of customer satisfaction -- and they might not. Just ask for it and see what they say. I don't think you're in any position to demand anything though, unfortunately. If you want to raise a stink, ask for a refund through twitter.

    Okay, so you did not sign up for full coverage for your dad.

    You signed up your father........ and gave them your debit card information....... and now are "appalled" that they are charging the card that they were given for car insurance............ when you never told them that you no longer wanted coverage?

    It has everything to do with canceling the policy. Since the car no longer exists, there is no need for the policy. It was your responsibility to notify the insurance policy to cancel so they would quit deducting the amount.

    Let me make sure I have it right.

    Dad has a car
    Dad signs up over the phone for insurance with All-State
    Dad gives them your credit card to make the payment
    Dad wrecks the car in the first month
    Dad never cancels insurance or files a claim for the car
    Three months later you want your money back

    Is this accurate?

    If so I'd be surprised if they are going to give you anything back.

    You left out that OP knew that his father was using his credit card to sign up for insurance.

    He isn't going to get anything back unless the laws are different than in Illinois.

    Did you think he didn't have insurance after having a phone call and agreeing to sign up for insurance?

    If he had actually wanted to use the insurance that he signed up for over the phone, how would you have felt that he made an agreement and signed up for insurance on the phone, but they denied you when you needed to use it because you didn't e-sign it?

    Why don’t you just ask your dad to pay you back?

    That would be pretty shitty though. I’d just cancel the insurance and forget about it.
