Trump winning would be worse, because it could potentially lead to a very one way leaning Supreme Court. Wish there were more moderates on both sides on the court.
In Dobro's scenario the Dems hold the Senate majority ….. in that case , Trump isn't getting a justice confirmed that they don't approve of - he'd have to go with a moderate. That's the best of both worlds either way - Biden wins and the GOP wins the house / senate or Trump wins and the Dems win the house / senate. Neither of them is going to be able to put up wingnut judges and expect confirmation. We don't lose …. unless one of them has a supermajority that can override a presidential veto.
If Trump wins, I think he just tries wingnut after wingnut to push through for SCOTUS (if RBG decides to retire of course). I have no faith in the man to learn or not take the most divisive route. I could see Biden going with a moderate judge to get it through McConnell, but then again... Mitch didn’t let Obama appoint a moderate judge for over a year so a new SCOTUS is no guarantee either way. RBG might have to live till 150. FYI these are actually more realistic scenarios than one might think IMO. Especially the Biden one (with maybe the Dems holding the House most likely). It makes all these aspirational progressive plans pretty unlikely to be realistic platforms to run on. Securing ACA, Expanding Medicare, HR1, and a middle class tax reform would be the most realistic Democrat 2020 campaign goals even though it’s not the sexy Bernie pie in the sky stuff people think the Democrats will just be able to snap their fingers and change overnight. Split government seems to be pretty likely for the coming future which is sort of what the founding fathers intended to begin with. But it will be frustrating for Dems who have such a challenging path at having the ability to have any legitimate recovery from this damaging hell hole of a presidency.
