Why should he win against the Post? They didn't make anything up. He's a douchebag. Phillips is a creepy old guy. Both ultimately received more positive attention than either deserve. What's weird is the same people I see complain about people just trying to get rich by suing people support a family doing the same.
If it were one of my kids, I'd have defended their character, but not the behavior in the video, nor would I sue. Granted my wife might, she has less qualms about trying to get rich off other people.

It's pretty difficult to sue a news publication in the United States for defamation. It will be interesting to see how this goes. I haven't read/seen what was written by the Washington Post with regards to Sandmann. The 24 hour news cycle sucks. Immediate hot takes are the norm and that's a shame. It's all about clicks and ratings. Pundits/Journalists should be more careful with what they put out there. I never went to journalism school but I would think journalists should feel some sort of "duty" on ethical grounds to really investigate before opining/stating something definitively.
Who said he deserved to be threatened? Personally, I find fault with those who are doing the threatening, not the reporting on a viral video. He stood there with a smirk. Kind of the hallmark of a douchebag. Imagine if he just moves what the story is...
I'd say from the little I know about you and this kid, I'd say you (presumably an adult) calling a 16 year old kid you don't know a douchebag for smiling and wearing a hat raises your douchebag meter to a higher level than this kid. Not saying you are a douchebag....I don't think I'm enough a douchebag myself to call someone else a douchebag, who I don't really know. Just from the little I know about both of you, if I had to choose which one was closer to approaching the level of "douchebag" based on the information at my disposal it would have to be you. Maybe others can weigh in. Who comes closer to being a douchebag? 16 year old kid who wears a hat and smiles at someone, or adult who calls a 16 year old kid a douchebag for wearing a hat and smiling at someone?
A douchebag tends to smile in situation where it is inappropriate to do so. It is legitimately textbook douchebag.
