    "This is a straight statutory interpretation case, not the 'constitutional crisis' widely described by critics. There are possible claims against the funding conditions, but Congress gave the President not just the unfettered authority to declare such emergencies but the largely unconditioned appropriations that he may use to build the wall":

    This is why President Obama was able to go to war in Libya without a declaration and fund the entire war with billions of undedicated funds. Neither House Speaker Nancy Pelosi nor most of the current Democratic leadership made a peep of objection at this. But when it comes to the wall, Democrats have indicated they will rely on the ruling in House of Representatives versus Sylvia Burwell, in which the court declared the House of Representatives had standing to sue over executive overreach and that Obama violated the Constitution in ordering the payment of billions to insurance companies without authorization from Congress.

    I was lead counsel for the House of Representatives in that case. Ironically, Pelosi vehemently opposed the litigation as a frivolous and unfounded challenge to presidential authority. We won the case. Superficially, it may look like the wall controversy. Obama sought funds from Congress and, when unsuccessful, acted unilaterally. But Obama ordered the money directly from the Treasury as a permanent appropriation, like the money used to pay tax refunds. Congress had never approved such payments.

    Conversely, Trump is using appropriated funds. Like the authority under the National Emergencies Act, Congress gave this money to the executive branch without meaningful limitations. Trump now has almost $1.4 billion in newly approved funds to use for border protection. He has identified about $8 billion in loosely dedicated funds for military construction, drug interdiction, and forfeitures. Even if a court disagreed with the use of this money, Trump has the power and funds to start construction of the wall.​

    however, doing what you are doing makes you a hack for trump. over and over again you and mick fry-brain are making up baseless claims and then get your panties in a wad when people call you out. if you dont like it then perhaps you should try being more honest.

    yall are demonstrating exactly why trumps rhetoric is so dangerous to this country - he was upset that he lost the popular vote so he threw out the baseless claim that 3 to 5 million people voted illegally. it was his way to make himself feel better about losing the popular vote...the problem is that the trumpublicans now do the same thing. anytime they dont like the facts or numbers they just dismiss them, declare them fake with no proof, and make up some blatant lie in order to make themselves feel better. again, yall are demonstrating how dangerous trumps rhetoric is - it manipulates yall into doing the same thing and constantly going around spouting total b.s. unsubstantiated claims.

    i used to constantly point out how bush AND obama shredded the 4th amendment and eroded our civil liberties and i could point to specific examples of them doing so. if you say democrats want to do away with the 1st and 2nd amendments then it shouldnt be that hard to cite examples of them doing so.

    on a related note, no president will cede the powers that their predecessor grabbed...we saw it with obama when he expanded on many bush era surveillance overreaches. which makes what trump is doing all that more dangerous...what is to stop president ocasio-cortez in 2028 from declaring a national emergency to deal with gun control or climate change and citing trump as the precedent to do so? do yall not understand the long-term ramifications of what trump is doing?

    as usual, couldnt disagree more with lyin' ted. he is claiming that people who want to fix our campaign finance system and limit corporate influence are anti-first amendment. teddy is an advocate of allowing unlimited donations from corporations and mega-donors. he doesnt want donors to be forced to disclose who they are giving to or where politicians get their money. i think most americans would disagree with his claims that people who do want that are anti-first amendment.

    dont yall want to know where the money is coming from? as voters and americans dont we have that right? we should know where our representatives get their funding, right? ...this shouldnt even be a partisan issue - republican or democrat, they work for us.

    lyin' ted and the trumpublicans think that being against unlimited corporate influence on OUR politicians = being against the first amendment. i think that is just sad.

    the first sentence in the 2nd paragraph is typical lyin' ted spin - "We have seen President Obama publicly rebuke the Supreme Court for protecting free speech in Citizens United v. FEC"

    Funny how the pro-trump legal minds get trotted out... turley supported trump's Muslim bans (and the extreme vetting), turley believes the media is biased against trump, turley believes the Mueller charges against manafort and gates had nothing to do with trump or his campaign, turley believes trump doesn't have to comply with subpoenas, and now the executive order to get his wall built.

    The same turley that former speaker of the house john boehner hired to sue President Obama for presidential overreach (the third lawyer boehner tried for this lawsuit). I guess executive overreach was bad before, but OK now?

    Is a Third Lawyer the Charm for House Republicans?

    You're joking, but I'll be straight with you. Nope, not a chance, but I do know some more than slightly confused Republicans. I voted against Nixon and every Republican presidential candidate since Tricky Dick. Stopped hunting a long time ago, except with a camera, and am for several measures that would improve gun safety, including restricting the sale of certain types of firearms and accessories, like high capacity magazines, to highly vetted collectors, who would pay dearly for the privilege. Extensive background checks. Required gun safety classes before getting a license, and run by the local county, not the NRA. Programs to buy back guns at market value from those who just have them sitting around in their closet, collecting dust. Folks that do hunt game don't bother me. The extremists do, however, a lot.

    It's a hobby for a lot of folks, not the matter of life or death that some make it out to be who have been sucked into the NRA vortex. I like to go to a range or out in the country on a friend's deer lease and blast away, but at targets, not creatures (unless I was protecting my loved ones in extremis). It's fun! I am far from a 2nd amendment fanatic, but sadly, I do know a few. I think the NRA is a money making scam perpetrated by its leadership to enhance and protect their high salaries. It didn't use to be the way it is now, but those days with any hint of moderation have been gone for many, many years. The NRA sold its soul long ago to the gun manufacturers, and now to one political party.

    the Dem lawmakers are united against the Emergency Declaration to build the wall; the GOPs are split on the issue.
    Rubio, Collins, Cronyn and others have spoken against it.
