Sorry I don't think you are comprehending the point people are making and legit questions being raised concerning the outcome of this case pursuant to a 1 year peace bond. Of course a dropped charge doesn't necessarily point to innocence nor guilt for that matter. No one is insinuating anything other than the obvious that the decision not to prosecute is not the same as finding someone innocent or guilty--and yes it could also mean that the charges were frivolous or unwarranted to begin with, or that a witness refused to come forward and/or the prosecution has no evidence with which to proceed. There are a lot of things it could be. So yeah everyone is speculating but that was the point of the discussion--people are wondering out loud what this could mean, plain and simple. The fact remains that Osuna and his attorneys DID agree to a peace bond which likely (operative word again) implies that there was some substance (tangential or otherwise) to the original charges. And if the truth ever came out, it could just as easily be a misinterpretation of events--a he said she said scenario. I think some well-meaning folks were simply questioning the meaning of the outcome and peace bond. No one was accusing Osuna of being guilty, just trying to interpret the decision. In the end, it is one of the best possible outcomes for him and the Astros and hopefully he sails through the 1 year with no incidences and this will be behind him. As you say, no one should rush to judgment or assume guilt, but speculating outcome of events is ok in a forum.
Even if you want to argue your innocence, you want the case hanging over your head requiring you to go to court for how long, affecting your work, and possibly be declared guilty? (As if no one has ever been mistakenly convicted) Or accept the probationary period/plea bargain and be done with it for now? With no permanent blemish on your legal record. Conditions for the one year are quite stringent, with violations resulting in jail time, I believe. When there are no more legal repercussions, I believe there will be a time he is ready to speak.
Your deduction is 100% logical. But in my experience, it is incorrect. The act of agreeing to a peace bond, in practice and in reality, does not substantiate the underlying charge at all. And look, I get the theoretical argument. Why would someone asserting innocence agree to anything? I'm not going into delve into how Texas and Canada laws differ, but we have similar instruments to peace bonds in Texas, and what I can say is this: Defendants who unwaveringly assert innocence agree to "peace bonds" all the time. So, I wouldn't put any weight on the facts, or on guilt or innocence, by virtue of someone agreeing to a peace bond. And hey, I'm just trying to give CF an idea of how these cases work in real life. But what the hell do I know. People will believe whatever it is that they want to believe.
Ray Rice was put into a pre-trial diversion, which is somewhat similar. And we all know he wasn't innocent. Personally, the hit wasn't the disturbing part of the Ray Rice incident, it was the seemingly lack of concern for her well being afterwards. Osuna most likely did something which is why his attorney pushed for the peace bond from day 1. Peace bond was always the most likely outcome, and so it isn't surprising. Maybe details will come out that confirm what he did or didn't do, but reasonable chance we never know.
Major League Baseball has suspended Addison Russell for 40 games without pay, retroactive to September 21, under its domestic violence policy. Russell has agreed not to appeal the decision. The shortstop was placed on administrative leave two weeks ago after his ex-wife published a blog post describing years of physical and emotional abuse by Russell. Been reading some of their articles on their sbnation page and many of them want no part of him anymore and see him gone. I guess the big difference is he was already on the Cubs and there's talk that he has played his last game with them, while the Astros traded for Osuna during his suspension
Was Osuna's service time issue ever confirmed regarding his arbitration? I remember reading he may not get credit for this season and we might have an additional year of arbitration.
He doesn’t get credit for that service time. Same deal with a drug suspension. Yes, I believe that gets another year of team control
