    There would be nothing wrong with an FBI background check if the president made them do it, but it wouldn't have uncovered anything else, it would have just gotten sworn statements like they already have and would have delayed the process a bit more.

    His answers about drinking are ridiculous

    Doesn’t want to put a number on beers (smart strategy)
    Has never passed out
    No chance anything has happened while drunk that he doesn’t remember (lol)

    Those aren’t really believable for someone who was a binge drinker as a young adult

    Kavanaugh will be confirmed next week or Barrett will be confirmed in December. They aren't extending this because it would mess the timing up to get Barrett in before the new Congress convenes. If they start the process with Barrett in the next couple weeks they can get it done no matter what happens in the mid-terms. They don't want to be held to the timeline of an FBI investigation they have no control over.

    Right I agree with this mostly that it wouldn’t have amounted to anything. The idea that they can’t is stupid though.

    doesn;t mean all background checks are violations.

    That might matter if there was credible evidence that he ever did anything wrong while drunk that he doesn't remember....but there's not.

    he didn't say 'never passed out'. he said 'never blacked out'. those are not the same thing.

    That's where we agree. Not only can they, the FBI/DOD has done 6 of them on him already. They could do a 7th, but there's just not a reason to do so since they have the sworn statements by everyone involved already.

    I wouldn't want to put a specific number on it either though. How much is too much is potentially a trap question. If you say 5 is too much, the question then becomes about drinking 4 beers in an hour or whatever. It's best to answer it like the p*rnography question "you know it when you see it" or something similar.

    He's a federal judge nominated to the Federal Supreme Court.

    By your logic, the military can no longer do checks for security clearances because of states rights.

    BTW, I would have expected a legitimate check would have uncovered this and Trump would have known about it before nominating him. I would hope that the background check for a supreme court justice would at least as comprehrnsive some pimply faced kid getting access to the secure safe.
