    This is why you don't jaywalk. I've seen so many dangerous crosses downtown. People pull out of garages and don't expect someone in the middle of the street.

    Because the driver was not in the wrong. Article said he was not using a crosswalk.

    The moment you jaywalk, you have no defense. If a driver hits you, the driver is usually free of any liability because you jaywalked. Even more than that, if a driver swerved and hit someone else while you were jaywalking, the person jaywalking will be responsible for any damages.

    People driving humongous ass motor vehicles (soccer mom van in this case) should still pay more attention to foot traffic than they do now.

    The article also said it was still under investigation. No one deserves to die when they're just walking down a street.

    Driver not legally in the wrong, but was 80 years old...sad news regardless of who’s in the right or not.

    Well I guess this hits close to home more to me than any of you guys because back when I was in elementary school walking across the street at a Hilcroft intersection i was actually at the crosswalk and the driver still got away with no charges.

    One broken fibula, 18 stitches, and a metal pin later... and I feel it to this day when the weather changes.

    Very sorry to hear that. Don't know anything about him, but lots of respect for his dad. Burying a child is brutal I'm sure.

    It's a terrible tragedy but it looks to be an accident. Unfortunately they happen all the time and all we can do is enjoy our time on this earth; RIP.

    I don't disagree. Someone was killed a couple of blocks away from my house last week and while they were jaywalking, its a street that has poor access to crosswalks since the entrances are usually covered in snow. As we build wider streets (which were presumed to make things safer for pedestrians) we actually created a problem because drivers tend to speed on wider streets. As a whole we've created a more unsafe environment for pedestrians.

    But legally today, drivers do enjoy near immunity if a pedestrian isn't on a cross walk. Just a sad fact of life. And drivers tapping on cellphones while pedestrians are walking hasn't helped either.
