    Good thing I very rarely read or participate in D&D...'eh. Talk about "unwavering ferocity."

    If it makes you feel better, I don't watch TV much, read fb much, twitter or email, or anything else you can think up wrt cruising the internet and/or wasting time. Nor follow football, baseball or any college bball. I'm fockass'd on pro basketball, which this topic crosses into. I'm an NBA junkie.

    Plus, this FBI sting isn't a random topic for me. I think students deserve pay, and (and) it is a key to improving basketball. I think this sting truly pisses me off, like few topics have this entire year (even Trump). sorry. I should probably back away from the keyboard. :eek:

    Actually looks like we don't even need to get to that as they are being charged with Solicitation of bribes and gratuities by an agent of a federally-funded organization. Guessing grants and federal funded research would put the Universities in this category?

    Yeah, that's all I thought they were doing. Read that last night.

    That is not Federal bribery. Yeah coaches are Public Officials, because their state university accepted federal money. Christ. That will not get a conviction.

    But they are not public officials being charged with federal bribery. They are being charged as an agent of a federally funded program soliciting and accepting bribes. Regardless of how you feel about the whole thing (which I agree with you quite a bit on), it certainly seems that the elements are being met here if what has been presented is true.

    Should also be noted that we have no idea what taps, e-mails, and other evidence there is and will be discovered.

    Maybe it's just me, but I don't understand the death penalty in the NCAA. Maybe I'm seeing it incorrectly, but to me, it's like if there was a murder in Chicago. After the crime was committed and the parties involved were sentenced, President Trump comes in and cuts off federal aid to the city to inspire them to elect better leaders to reduce crime. In the mean time, the people of Chicago suffer as well as their elected officials. It makes no sense to me.

    OK, I now see the wording you were referering wrt the university getting $10k or more in grants for the year. I'm going to check later for use of that Section 666 before. Those slippery bastids...that's mighty vague with widespread power.

    Note the word "corruptly" is a biggie. That would is mentioned as a key word that prosecutors must also prove in order for something to be legal vs illegal bribery. It means your actions were done with the intent to do harm to your employer or fiduciary beneficiary....like award a contract to a company with low quality concrete vs the competitors who deserve the job. If you accept gifts from a honest competitor of the quality you are looking to select, then you do no harm and the gift is fine.

    My guess is they will have to prove the coaches either did harm to the university via ... what? ... putting them in jeopardy of NCAA violations? Or they did harm to the student-athlete...by funnelling them money? no. I suppose by putting in a good word for various agents or addidas? hmmm....I mean, first they have to prove that the coach has a duty to uphold wrt good advice about future financials planning. Then they have to prove that it directly resulted in doing the student harm. This isn't quite the same as a corrupt person selected a bad vendor...they had complete power over that. Student still makes the choice over agents....and can't make that choice until he commits to the NBA draft, anyhow. So, seems introductions to agents hasn't "Corruptly" completed any real action of harm, since they can't sign yet.

    "Corruptly" is the key word.

    btw: One of the coolest things to come out of this is I learned Chuck Person's middle name.

    Chuck Connors (yes plural)

    He was a gunner in the NBA, too.

    So from what I gather here, the FBI and US Attorneys have spent 3 years on an extensive investigation that serves no purpose and which they can't get any convictions, all to help out the NCAA float a trial balloon. And amateur internet lawyer who's googling various terms as he goes knows what can and can't get convictions, while the US attorneys that have spent years on this are just clueless.
