I'm still probably going to vote for Hillary because the alternate decision would be something I couldn't accept, but why is 'negligence' not a criminal offense? I know when I was an enlisted man, if I took classified information home with me, I would have been court martialed. I know as a liberal here, we are all for equal treatment of justice regardless of economic and social class. So why doesn't this desire of fair treatment of the justice system not translate to Hilary with us liberals?

The FBI can only hand over evidence and recommendation. The Justice Dept are the ones who officially decides to press charges are not.

So they concluded that Hillary sent and received classified information at the time it was sent, she also stored classified information on private servers......but despite that they don't recommend prosecution due to it being a hard case to prosecute because of all of the factors involved.

Because, like with most criminal prosecutions, intent matters.

LOL this is great. I like the line about not intending to violate the laws, but they were careless. I have to use that next time I get pulled over for speeding. Maybe my defense attorney friend should start using that line on all the cases he has.

    Can you substantiate that accusation?

I hear all the critique of the Clinton Foundation and such, but they followed Republican recommendations made during her confirmation hearing that no new donations be made while she was Secretary of State which was beyond the law.

I am not sure what she could do - have her husband end a foundation that provides earthquake relief and lowers the price of HIV drugs to millions of people?

When it comes to the law it doesn't, but when it comes to the presumptive Democratic nominee for president, it does. If she was just about anyone else, they'd prosecute because they found evidence she broke the law.

Actually, they wouldn't. In fact, likely thousands of times every day, people aren't prosecuted for laws they violate despite evidence. There is and always has been selective prosecution in this country, and a big part of that is determining intent to violate laws. You just don't seem to understand much about how our judicial system functions.

As far as this specific issue, classified emails are routinely sent on unclassified systems in this country, especially when talking about retroactive classification. It's just how it is. The thousands of government employees that do it are routinely not prosecuted because there is no intent to do anything harmful.

If anyone else was found sending and receiving classified information as well as storing classified information on private servers, they'd be prosecuted for it....even if it was just incompetence that led them to do so like they are claiming with Hillary.

In this instance, you are completely wrong. The ONLY reason she's not being prosecuted is because of who she is. If I was caught doing the same, I'd be in jail right now.
