I think perhaps it has more to do with the fact that he has increased intel as POTUS that he didn't have as a Senator at the time that may have changed his perspective. When the Patriot Act first came about I remember reading that it would be a temporary measure once implemented but once the powers that be have it, they wouldn't want to give it up anymore. Democrat or Republican. It's hard to voluntary relinquish power that's bestowed upon at nomination.
