    Hmm, let's see: I was colored when I was in elementary school. Then I was a Negro in high school - although the KKK (and George Wallace) used a different variant of the word to describe me and mine. Then I was Black in college (Power to the People!). Then, somewhere in the 1980's, I became African-American. It's all so very confusing sometimes...

    Can someone explain to me why the president has to Appoint a SJ? I thought the SC should be independant of the government (and the parties).

    Just something I do not understand. I understand that is how the american law works I just do not understand why it works this way.

    Well it has to be nominated by someone and if you have one person nominate then a body of representatives of the people confirm or deny that nominee then you can say that the people have a pretty good say over who becomes the SC justice.

    Because the President is leader of the nation as a whole, elected in a nationwide election. His position reflects the majority of The people and is less subject to regional bias. It is the Executive Branch which means it has the responsibility for administrative and supervisory duties. Also though, the American system is all about checks and balances so while the President has the power of nomination he does not have the power to just appoint or confirm a Judge himself.

    But I don't think The Framers envisioned obstruction as a political strategy among reasonable statesmen. The business of the US courts and federal bureaucracy has been significantly limited by it for the last 7 years.

    To follow up on what others have said. The independence of the SC comes from the lifetime appointments. As the last few years have shown the SC leaning can be very different from that of the rest of the country and doesn't always shift when the country does.

    The foundering fathers want checks and balances so you won't have someone like hitler nominated to SC. The purpose of the confirmation is not to extend party ideology, any reasonable nomination should be confirmed, I am sure the founding fathers are rolling in their graves now.
