No indictment for officer who shot Tamir Rice; reasonable to assume officer was threatened

    The grand jury made their decision based on the facts presented to them, not based on sensationalist media reports.

    (CNN)An Ohio grand jury has decided not to return an indictment in the 2014 police shooting death of 12-year-old Tamir Rice, prosecutor Tim McGinty said Monday.

    Rice was holding a pellet gun when he was shot. It was "reasonable" to believe that the officer who killed the boy was facing a threat, McGinty said.

    The officer was in training outside a Cleveland recreation center in November 2014. The shooting sparked controversy given Tamir's age and the fact that he had a gun that resembled a handgun.

    I find it disturbing that law enforcement doesn't even utilize the most basic tactics of approaching a suspected armed individual that mere infantry riflemen utilize.

    1. There is a suspected armed individual out in the open.
    2. LE officers approach individual in squad car with considerable distance.
    3. Officers exit squad car and use cover and concealment of the squad car and leave a sizable distance between the suspected armed individual but not so much distance where verbal commands cannot be heard.
    4. Officers shout explict verbal commands such as "Drop what you are holding to the ground slowly and then raise your hands slowly!"
    5. 12 year old Tamir Rice complies. Officers slowly approach Rice and discover that the object Rice dropped was a bb gun.
    6. No one dies.

    The level of incompetence to not follow those steps and instead just barge in right up to the suspected shooter and take him out should be grounds for termination.

    Open your mind to the facts of the case. You're over simplifying what happened in an attempt to appeal to sympathetic emotions.

    The facts of the case are a 12 year old boy was shot by a police officer. That is really the only fact needed.

    Look at the poor thinkers in this thread. They try to oversimplify the situation, clinging to the tagline they read on their favorite sensationalist media outlet (ie, HuffPo, MSNBC, etc.). They are unable to review all the facts available, like the grand jury did. Life is not summed up by the 10 word tagline you read -- put in the work to dig deeper and collect more facts before sharing your position.

    That is a fact, not all the facts.

    And I do find it tragic that a 12 year old boy lost his life. I pray for his family.

    I also hope that others may learn from this, and not put themselves in a position to threaten police officers with something that could appear to look like a gun.

    This was inevitable, there was no crime committed thus no indictment. It's an unfortunate incident, but not a criminal one.

    We should all learn from this and not give our young children realistic guns and let them play unattended at the park. If he had a mother that cared just a bit more about him, he might still be alive.

    There is a dead 12 year old BOY.

    I don't think there is anything to gloat about in this situation.

    There is no winner here, just a bunch of losers.

    The grand jury made their decision and we all live with it for good or bad.

    I just hope the attention this case got will keep something like this from happening again.

    ****ing gross that you're all fine with this. There's video of the incident, which ironically is shorter than it would take to read a "Huffpost" lede about the story.

    I'm white and we played with air soft guns in public. Never once did we have police called on us and, if I were a betting man, I'd guess that we wouldn't have been shot in under 10 seconds at 12 years old.

    But, of course his could've been prevented had Tamir's mother taught him respect and a quick transition to prone position, right?

    Based on the evidence there is no legitimacy in believing that these cops acted reasonably.

    Justice system fail.
