You all know Larry Coon ... the Author of the CBA FAQ ...

He just posted a blog that says DMo is now under contract with the Rockets. So, failure to report means "the Rockets have all the rules related to player discipline for failure to report at their disposal"

Clutch: Please merge if you want, but thought it might get buried in other thread, and thought some would appreciate Coon's take all in one place. And as always, I'll update this post with related news, plus comments Bima might make elsewhere.

Key points he makes -- Failure to show can mean these:
    • Withholding pay
    • DMo losing credit for a year of service, so Rox can keep him and DMo can wave that March 1st waive date goodbye
    • Doesn't matter what Utah says (tampering or not), Rockets have a Player who falls under disciplinary action, so they can just sit and not pay and DMo gets no credit for time in service
    --------------------------------------------------------------
    What is Motiejunas doing?
    Excerpt

So the Rockets have two options at this point. First, they can just sit tight. Their first refusal exercise notice remains in effect until Motiejunas decides to report. He can’t sign or play anywhere else, including Brooklyn, in the meantime.

[Second is stuff we know from Woj about dropping Offer Sheet and returning DMo to RFA....]

And it could get worse for him. The CBA also says a player shall not receive credit for a year of service for any year in which he “…withholds playing services called for by a Player Contract or this Agreement for more than thirty (30) days after the Season begins.” It’s important to note here that the rules for restricted free agency say that when a team issues a first refusal exercise notice, the player and team “…shall be deemed to have entered into a Player Contract.” Motiejunas is, for all intents and purposes, under contract with the Rockets now, and the Rockets have all the rules related to player discipline for failure to report at their disposal (along with the right to kick him to the curb by withdrawing their first refusal exercise notice).

This all seems pretty clear to me, so I’m still not sure what “rights” Armstrong is referring to. Maybe his end game is to get the Rockets to withdraw its first refusal exercise notice, and then Armstrong and the Rockets negotiate a separate contract that is more favorable to Motiejunas. But why should the Rockets let a player leverage them into signing a different contract that’s less favorable to the team, when the team holds all the cards here?

    Armstrong isn’t exercising a right. He’s trying to strong-arm a team.
    --------------------------------------------------------------

Further things this can mean, but pure speculation on my part:
    1. The March 1st Waive date goes away if DMo never reports for duty. Thus we can cut him even later and he'll lose a whole season.
    2. Can Rockets get the March 1st date pushed back equal to any suspended games.

What an ill advised move by DMo.

B.J. has to get fired, there's no way a competent person would let him represent you again.

So my understanding of the analysis is: we don't have to waive the physical, we can just dock his pay for each game that passes.

    Is that correct?

The Rockets are spending resources on this now. Who is going to compensate us for that? It's not BJ I'll tell you that much.

This was so meticulously done. Leaking that he is good with the players (trying to negate the cancerous effect he could have on chemistry). Saying that he will play hard for the team whose jersey he wears (he did not intend to put on our jersey, so to me this is him saying he will not give his all for the Rockets). Signing the lesser offer sheet first, which means he fully intended to pursue Jazz offer sheet too but wanted it in that order.

This is all fine, but I am opt not to build up more drama for a guy that is not going to play. This is not basketball. Just let him walk to wherever he wants to play, clearly it's not us now. This is so fundamental that any kid will understand not to do it. We can blame it on his agent, but in the end, he has a choice of firing the agent. I am questioning his integrity and certainly you don't want a guy of less ability like he is around the locker room. Just let him walk.

So basically the contract he signed only comes into effect when he starts playing by the rules.

Until then he cannot play basketball anywhere else.
    He's screwed.

Big question: how does Morey trade him/ what could he get?

He won't be around the locker room until he fronts up willing to play.
You don't let a player agent screw you over by telling his client not to show up do you?
If he wanted to go, he should have brokered a deal to get DMo out of here. Not do the whole 'just don't show up' thing...

based on that blog, DMO needs to withdraw from his agent's contract.

Remember that night/thread when he invoked the "I have inside information but you all can't have it unless you ask to be part of the newsletter subscription" act of arrogance? Good times, Haymitch, good times.

I mean he has crossed the line that there is no turning back. Just cut him and be over with it. He gets way too much attention.
