This question is concerning Bankruptcy and a mortgage/foreclosure.
I’m going on two years of a discharged bankruptcy in which my
previous mortgage was included. ( I surrendered my property to the court )

I noticed the ( Mortgage Co.) is still reporting a balance ( total mortgage )
and a past due amount ( I assume what they sold the property for minus the total mortgage )

My question is, are they allowed to report these figures even though it has been discharged ?

The mortgage company is reporting it on your credit report, I assume??

I can't tell you how many times credit reporting agencies screw up reports from bankruptcies. I would contact your mortgage company and ask why they still show you as owing any obligation to them. When you turned the property over, that should have done it...that and the discharge from the bankruptcy court.

If the problem is with the reporting agencies, send a letter to all three credit reporting agencies and attach your bankruptcy discharge. Let them know the obligation is done....

Thanks for you help and yes it is a credit report issue. Here’s another question pertaining to the same.

The mortgage company reporting this information is not the original one I had., The funny thing is

They purchased my account from my original mortgage company after my bankruptcy was discharged, (about 4 months later ) They didn’t even know they purchased a bad loan.

( actually, they purchase the whole mortgage division from my original lender, and were stuck with a lot of bad loans, I even found a article stating legal action my former lender for fraud )


So my question is, can they even report this at all ?

p.s. I will be more that happy to compensate you for your help.

I don't know the answer to your question...I don't do a ton of work with credit reporting agencies...but IT SEEMS TO ME (please note!! no guarantee on this statement!!!!!) that they have slandered your credit by reporting something that isn't correct. When you file bankruptcy and discharge a debt, it shouldn't show up anymore, as I understand it. I would contact the reporting agencies and let them know if I were you. I don't think you need to pay an attorney to do that, quite frankly...
