NFL probing Patriots' possible use of deflated balls during AFC Championship

    NFL- where gossip and scandals happen. Lets get back to playing football. Who gives a crap. They would of still destroyed the colts.

    The report, from Brady's agent, says they gave the league a list of numbers that Brady called or sent texts to, for them to follow up on. They didn't turn over the text messages (the phone was destroyed). The agent also changed the tune and said Brady wanted a new phone since the iPhone 6 just came out....even though it came out around September of the prior year. That also kinda contradicts the original "Tom destroys his old phones" story (besides, the league already knew about an older phone that wasn't destroyed).

    It looks like the NFL won round 1. The case will be heard in NY.

    How could Brady's super legal team let the NFL beat them to the punch?

    Any lawyers in here?

    How can a private organization operate if they have to go to federal court every time a member of the organization disagrees with their policy? How does the league not have the authority to dole out punishment that it sees fit?

    The League is not a normal organization. They are essentially a government approved monopoly which allows the government oversight.

    But wouldn't a CBA outline stuff like this? Or is this an attempt at an appeals process?

    Essentially, Brady is saying the company is violating the terms of their contract (the CBA). It would be like an employee taking a company to court for not paying them under the terms of the work contract they signed.

    The other cases that got overturned in federal court...those cases were overturned bc the judges found that the League was in violation of the CBA, not because there was some overriding national law. There are compelling CBA related arguments for both sides in this case. I just listened to a DeMaurice Smith 30 minute interview and he's pretty convincing.

    DeMaurice Smith is a really smart dude. It looks like Goodell violated all sorts of procedures written within the CBA or at worst stretched his powers to the max. The appeal is on CBA grounds based on those violations, not if Brady cheated, and it might work.

    Just remember kids, this is not a ruling of guilt or innocence. It's merely whether Goodell's punishment of Brady's conduct was within the legal rights of the CBA.
