Loaned a friend $3000, gave me a bounced check, what to do?

    I did something I regret. About a year ago, a friend who is a trust fund baby, has a father who is worth millions, said he needed an emergency loan because his bils are due and swore to me that is father was giving him money to pay his rent, bills, etc. but he wont get the funds until a week later. I was reluctant at first, but he pulled out a checkbook and wrote me a check for the $3000 and post dated it for a week later.

    The check bounced and he has made progress over the past year and has given me a few hundred each month but now he owes me $1200 and we got into a fight and he gave me the middle finger and said do what I have to do and he wont pay me..

    is there anything I can do at this point? I still have the Wells Fargo notice stating the check bounced he wrote me. We aren't really talking anymore and I learned the hardway that when is a friend is in need, dont help them...

    Which is more important, the 1200 or the friendship?

    If it's money, small claims court provided you have the bounced check.

    If it's both (because you're emo), be the bigger man and step back a little, guilt him with pride about being the bigger man while making him feel like a deadbeat.

    If it's friendship, or at least a test in it, buy him a beer and tell him, whatever happened happened. I expect the money because it's your word but do what you gotta do.

    what if he just denies it in small claims court or said he already paid me? would he have to prove he paid me, or would I have to prove I haven't received money?

    Go to his father and show him the bounced check and see if he will help you out.

    Friends and loaning money don't mix, especially that amount.

    As far as your court questions, we need a lawyer in here.

    If you're in Texas, I think verbal agreements are good. Receipts are better.

    If you're manipulative and down with war, manipulate/schmooze into some payment (like 5 bucks), then email with a verbal receipt. "Hey man, thanks for the 5 bucks, we're good for 1495 out of the [BOUNCED CHECK AMOUNT HERE] right?" That's some derogatory ethnic slur stuff right there, but it'd be submissable once he replies and acknowledges it implictly or explicitly...

    But hey, while I may be drunk, I'm not a lawyer... I just play one on TV.

    his father said its not his probem :)

    my son is 27 is what he said... he isn't my liability

    the irony is his father is a Tax Partner/CPA who has part ownership in a CPA firm and fully supports his son...

    makes well over 7 figures but he doesn't care..

    Obvious response.

    1) Parents back their kids.

    2) Rich people are generally cheap. Not frugal...cheap.

    3) Rich people prefer "**** you, pay me" over "**** me because of my deadbeat disappointment of a son, pay you"

    I am the only one who finds its ironic that this guys son gives me a bounced check and he deflects responsibility even though he 100% supports his son, his son doesn't work

    ^Check out post #12 holmes. It takes a mercenary attitude, but bury the hatchet in order to continue the payment. Never say you'll forgive the debt, just say hey we're still buds, even if I like being paid back, money isn't an issue for me right now....I understand if you need more time, but a little goes a long way in building back what we've built over the years.

    *** tactics, but hey business is business.

    Wouldn't that be spite since it's criminal over civil and there's almost a zero chance of getting your money back?

    I guess you can hang that as blackmail over the father if he gave a damn over paying for the lawyer expenses.

    I know just how to help, and I'd really love to, but I have my own issues right now. If you could loan me $2500 I could put all those issues aside and help you ASAP. I'll pay you back plus interest. Jontro can vouch for me.

    The bad check might be enough proof to show small claims court that he owes you money. Once that is established, the burden of proof now falls in your friends lap that he paid you.
