    Excellent posts.

Cops are civil servants. They should act accordingly. We need to always remind them of this simple fact. Yet, most of us are afraid to do so because we simply want to avoid escalation and move on with our day even in things like routine traffic stops. So, we often pander and give in, and even offer to voluntarily surrender our civil rights because it's not worth the risk of reminding a cop of his job description and duty.

Now, a majority of such cases involving a "mistake" by a cop are the result of poor situational awareness. If one can't make a sound judgement on what kind of action and/or force the situation requires, then such a civil servant should be made to do other less demanding work.

Case in point, the NYPD choking incident where cops attacked a man for allegedly selling bootleg cigarettes on a street sidewalk. They had him outnumbered and cornered. He wasn't going anywhere in broad daylight. No physical threats were made by him. The situation required patience and deescalation until the subject cooperates. However, the cops continued to escalate the standoff until he was simply attacked from behind, which of course resulted in him resisting his violent arrest. Then, a cop placed him in a deadly choke-hold and others joined in bringing him to the ground as if he was a terrorist about pull the trigger on a bomb. Again, the situation could have been easily diffused if the cops acted like civil servants and took into consideration the man's safety. He is innocent until proven guilty. Therefore, retains the same rights as any other citizen - to not be physical attacked by overwhelming force.
