Child Support

    My life was all groovy when my ex and I splitted up, we have a little girl together. I had for for a whole week and she had her for a whole week then we rotated like that every week. so basically half and half. One day out of the blue, she decided to take full custody and I have to pay for child support now cause I didn't want to take it to court. So I have her every weekend now. Thats not my problem. My problem now is after all my bills and child support payment. I am left with 72$ left each month (gas is included with bills) that means no eating out and no going out period. I am only 22 years old! How long do you guys think I will last?? I still have a positive attitude about the whole thing but man.. I cant even afford a gf now!!! :(

    Who decided on the child support amount? What kind of agreement did you sign? You say you didn't want to take it to court - does that mean you agreed to what she asked? Did you have an attorney? Did she?

    the child support cournt did, 20% of my income... we are both very mature about the whole thing, well really i am, since i dont want to fight her and just for her to leave me alone... I spoke to my attorney but then changed my mind cause I didnt want our relationship to get nasty. we just went to child support office. they did the calculations, and we signed papers. like i said, I dont mind about the whole child support deal cause its my daughter and I have more time to persue in my career and school. So weekends is fine with me. but the thing is I bought a brand new Lexus before I even thought she would do such a thing to me, I have alot of bills and did my calculations and ended up with 72 bucks...

    I havent gone out for the last month and don't even eat out at all... I stay with my brother and pay rent so I eat whatever they eat. I just dont know how long I can do this LOL, I went for a second job on weekends but then when i worked for 1 day... i missed my daughter too much so i quited the job. I have a full time job during the weekdays..

    If you're looking for advice, I would suggest trading in the Lexus for something more affordable.

    I went to do a trade when I was first paying for child support, it was a $10k upside down, meaning I would of lost 10k if i the trade and I only had teh car for 3 months. I tried selling it but no buyers, then after 2 months ago, a mexican old lady with no insurance hit me from the side, the side is scratched up now alone with my rims. I felt bad for the old lady andlet her go. F MY LIFE!!!

    I got kind-of screwed on child support recently.

    When we got divorced in 1995, there was a set amount of child support called for in the divorce decree. A couple of years into the arrangement, my ex-wife and I agreed that if I paid a lump sum plus agreed to pay for the kids' college, we would do that instead of monthly child support. So we agreed.

    Two years ago (just after my older son turned 18), I got a letter from the Attorney General telling me I owed over $60,000 in child support and penalties/interest. I figured it would be easy to take care of since the ex-wife and I had the subsequent agreement, but she decided she wanted to go after the $60,000.

    In the end, the court said that we weren't allowed to make a contract in which she gave up child support and that even the lump sum payment I made at the time didn't count toward my obligation since it was made directly to her rather than through the state. So, I owed the whole $60,000.

    So after a year of arguing, the court eventually let us settle for a lump sum of $40,000 in cash right then. Thankfully, I had $40,000.

    It was kind of my own fault. I certainly could've just said "no" to the changed arrangement or insisted that it be approved by the court before following it, but I was young and relatively poor way back then.

    The only thing that annoys me about the whole system is that the state can bring its full force using the Attorney General as a free lawyer and collection agency to get child support paid (which is fine), but if the non-custodial parent wants to enforce visitation, his only recourse is to hire an attorney at his own expense and pursue it through the courts, often to no avail (a custodial parent being sent to jail for defying the visitation agreement is very rare. A non-custodial parent going to jail for failing to pay child support is very common).

    It just seems like there's an inherent lack of balance and fairness. If the state has an interest in enforcing a contract, then they should have an interest in enforcing both sides of the contract.

    Yep I dont think its fair at all, 650 for a 2 year old child each month???? it would of been 750 a month if i wasnt paying for her medical insurance man... Guys keep this in mind i am 22 years old, I am glad i am responsible though thats one thing... but man, woman, can be so cruel, she cheated on me and i broke up with her. she went with the guy for 3 months, after 3 months she decided she wants for us to be a family again. I told her no and got slapped with child support letter...

    My Suggestion .. . like someone else said
    1. Sell the Lexus
    2. GET A LAWYER!

    QUESTION: How reasonable is your Ex?
    I mean REALLY? BE HONEST? Do not let emotions get in the way.
    [It doesn't sound very reasonable to change the game in the middle of everything]

    Maybe ya'll can work something out.
    You will have to STAND FIRM on somethings . . .or be run over.
    I REALLY hope she is reasonable . .. cause that will make life better for everyone
    If not. . . either 1. you get run over or 2. it gets NASTY

    how is your $3200/monthly being shaved down to $72? that's mind bottling

    lets just say I havent depend on my parents since i was 19.. I've been paying bills like a regular adult living on their own... phone bills, car note, rent, gas, car insurance, health insurance, child support, etc... it adds up..

    Guys I am not asking for advice, I do not want to go through this child support battle or custody battle again but I just want to talk about the subject for fun at work hahah, and hear stories as well. :)

    Isn't your child support based on your earnings? Shouldn't you be able to get it knocked down some?
