The first verdicts out of Apple vs. Samsung are in, covering claims 19, 8, and 50 of the so-called '381, '915, and '163 software patents, respectively — those are the patents that cover "bounce back" scrolling functionality, pinch-to-zoom, and tap-to-zoom. For claim 19 of '381, the answer is yes for all devices. For claim 8 of '915, the answer is yes for all but the Ace, Intercept, and Replenish. For claim 50 of '163, the answer is yes for all but the Captivate, Continuum, Gem, Indulge, Nexus S 4G, Transform, and Vibrant.
This verdict is setting such a bad precedent. Some of the stuff like pinch to zoom was done before the iphone.
On the question of inducement — in other words, did the Korean company force its US divisions to infringe — the jury ruled yes to all devices on '381, yes for all devices but the Replenish on '915, and yes for all devices but the Captivate, Continuum, Gem, Indulge, Nexus S 4G, Transform, and Vibrant on '163. The jury also ruled that Samsung willfully violated all three software patents — and failed to prove that any of them were invalid — which has big implications when it comes time to read off the monetary damages.
It probably should be invalid patents, if it was fairly common practice and Apple just got the patent. I don't follow the case, but just because something was done before doesn't mean you got the patent on it. It's first to patent; not first to do something. So, if Apple has the patent, then the argument is about validity of the patent. Appears Samsung failed to prove the patent is invalid. But I agree, no one should be able to get a patent by moving an existing technology to a new platform like mobile devices.
Samsung is getting raped by Apple right now lol. The real question is is Apple going after anyone else next? htc? Sony? Samsung was the 2nd biggest fish in the sea and they went after them first, don't know if they would take on smaller fish such as htc and Sony. They might go all in and take on the biggest fish, Google, now.
I dont like that so many of Apples patents are held up. Theres been enough endless litigation and this may lead to more. At the same time, I don't feel bad for Samsung. They've been doing this copying since long before they did it to Apple. Motorola should know firsthand. It's a sh***y practice and I don't mind seeing them pay for it.
This makes no sense. Why attack Samsung for doing it when other phone companies have the same feature?
Pretty much, look at other android companies and they did not copy Apple as hard as Samsung did. Samsung's products looked the most similar to Apple's. Samsung benefitted from this practice and it not only hurt Apple but it hurt other Android manufacturers as well because they were losing to Samsung.
