Well, I've had a fun day. I was rear ended on US highway 79 in Henderson, just past the 69 intersection. I was at a stop, and someone rear ended my truck at about 50mph. My truck is sitting in a tow truck yard place in Henderson. I'm lucky, all I have is a strained neck and broken nose. My truck was sandwiched between two pickups. I have never been in a wreck. I'm not sure what to do next. I'm not at fault in the wreck, the guy who rubber necked and rear ended my truck is. (there was a funeral convoy/motorcade driving down the other side of the highway so everyone was pulled over or, such as the dude in front of me came to a stop). I'm worried I'm going to be paying out the ass for the wrecker service that has my truck. Should I try to get it out of there immediately to get my truck? I don't know what to do next. Already talked to my all state insurer to start the claim. Do I need a lawyer? I only have liability insurance, so I'm needing the other guys insurance to pony up. Make sure you take care of your NECK for sure. This makes you feel like **** especially when your sleeping.
Ya, i was told I'll be in a lot of pain tomorrow. I'm on some hydro condone, and benzaprine right now. My poor truck.
I got into my first wreck a few weeks ago too... Go to a doctor or chiropractor if the pain remains. Its better to start treatments early than wait till it gets real bad.
You shouldn't have to pay for the wrecker. That should go on his insurance. In fact, make sure that EVERYTHING gets put on the guy's insurance. The tow, the medical bills, the rental car, everything. Worst case scenario, you might have to pay some fees up front, but you should be able to get a reimbursement check from their insurance company (my sister had to do this once). Just keep your receipts and keep in touch with the adjuster.
Wow, that would be fantastic. I'm stuck right now with no trasnportation, but the Dr. Gave me a sheet for 4 days off of work. Not really sure how good that's going to do me. Also, I'm a full time student. I got the name and number for the adjuster. I wasn't sure what she called him over the phone (all state agent), I was like....a jester? LOL.
Ya, got the prescription from him. Took a few for tonight, waiting to get knocked out and sleep. Hasn't hit me too bad yet.
I don't know, I'm getting the police report faxed to me in the morning. I was "out of it" after the wreck, broken nose was bleeding everywhere, and I was in a daze from the damn airbag / whiplash. Cops wrote everything down for me in the police report, which has the insurance info of all drivers, and witness reports etc.
Well, that's good - you've got a police report to go along with everything else. If the insurance company is any good, like the major more reputable ones, then they'll handle your claim well and should take care of everything with little effort on your part. I hope you get everything resolved and it all goes well!
I was in a funeral procession friday afternoon in Henderson. Chances are it could've been the same one. Anyways, I'm glad your ok.
A relative of mine just passed away from a severe head injury from a car wreck. It can always be worse... I'm sure you're glad to get away with some bumps and a broken nose.... Your truck should be the least of your worries.
If this person has insurance, his company will want to settle and settle quickly. Rearends are something that is almost always never contested as who's fault it is. His insurance company should pay for everything - truck repairs, tow, storage, loss of use (car rental), loss of value on your truck now having an accident on it's record, medical (this could be big and will definately scare most companies), loss of work (if you miss any because of this), etc. You don't want to gouge them but you do want to make sure you are not out of pocket in any aspect.
You might want to think about a lawyer, definitly go see a doctor....you are due some damages for their negligence. DD
Ya I went to the doctor yesterday, where they took xrays of my neck and nose. And saw something that made them want to do a cat scan of my neck. Although everything turned out ok. (just the busted nose). Thanks so much for the input everyone. My father is basically saying the same stuff, don't sign anything that they put out quickly, most likely they are trying to hose me for the amounts. I just found out to get he police report I have to go back to Henderson PD. So I'm trying to set up a ride to get up there. This sucks. I'm still hurting, but surprisingly not too bad....but new areas have shown up like a bruised left elbow that is awful. But nothing serious. I can't really do much until I get the reports. That's what I'm after today.
Should he tell his own insurance company about the accident? They'll often help in going after the other person's insurance company for you, right?
I called in to my insurance company (All State). I put in a claim to let them know i've been in an accident. They asked all the questions about what was damaged, headlights (drive and passenger side), review mirrors and tail lights etc. I wasn't much help though because I spent most of the time on the side of the road being attended to and controlling the blood from the broken nose.
I remember after my bad wreck a weird kind of full body pain -- the doctor explained that was soreness from all my free floating organs suddenly slamming against the front of my body.
Wrecks are bad on your body. Good think you are ok. The airbag busted your nose I assume? Also, don't worry to much, if the guy has insurance, then everything will be handled. They should even pay for a rental car for you. I got into something similar and I was in a rental car the very next day and was without my car for 4 weeks and didn't pay a dime for anything.... Do some internet research, maybe talk to a lawyer, look into getting a rental car and everything will work out so don't sweat it.
