Um, what? PC to come out against laws that prohibit illegal behavior? Did anyone else read this and instantly get a headache? So it is "politically correct" (whatever the hell that is supposed to mean... this is a very politically divisive issue, there is no "PC" side to be on) to be against laws (which by their very nature dictate what is illegal behavior) that prohibit illegal behavior (redundancy anyone?) Do you even know what political correctness means, let alone why it is inapplicable in this case? I'm guessing not. Besides the obvious logic failboat above, care to explain how this is "pandering"? Do you think the Suns are doing this to sell jerseys or something? When the state made this law, did you think it was "pandering" to xenophobic, draconian neo-cons? Of course you didn't Please, do the board a favor and spare us any follow-up posts.

Here is what the law says: FOR ANY LAWFUL CONTACT MADE BY A LAW ENFORCEMENT OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION OF THIS STATE WHERE REASONABLE SUSPICION EXISTS THAT THE PERSON IS AN ALIEN WHO IS UNLAWFULLY PRESENT IN THE UNITED STATES, A REASONABLE ATTEMPT SHALL BE MADE, WHEN PRACTICABLE, TO DETERMINE THE IMMIGRATION STATUS OF THE PERSON. THE PERSON'S IMMIGRATION STATUS SHALL BE VERIFIED WITH THE FEDERAL GOVERNMENT PURSUANT TO 8 UNITED STATES CODE SECTION 1373(c). E. A LAW ENFORCEMENT OFFICER, WITHOUT A WARRANT, MAY ARREST A PERSON IF THE OFFICER HAS PROBABLE CAUSE TO BELIEVE THAT THE PERSON HAS COMMITTED ANY PUBLIC OFFENSE THAT MAKES THE PERSON REMOVABLE FROM THE UNITED STATES. No idea what lawful contact means. Can't find a definition for it so it is going to be what some judge says. All you need is one yahoo judge and its hunting season on brown people.
We gotta take these bastards. Now we could do it with conventional weapons that could take years and cost millions of lives. No, I think we have to go all out. I think that this situation absolutely requires a really futile and stupid gesture be done on somebody's part.
Hey Gomer, what amnesty do I as a brown law abiding American citizen require? Enlighten me because it sounds like your statement exemplifies the inherent racism and stupidity of this law.
i still don't get what the big deal is with this law in the revised form. i've read it and i don't understand why people are in such an uproar over it.
One of the Constitutional challenges in regard to this law is that the Federal Government is specifically empowered by the Constitution to address issues of citizenships and national borders.
Leaving aside the concern among immigrants regarding profiling which has already been addressed there are a few other issues that make this law problematic. 1. As I mentioned in the post above the Constitution empowers the Federal Government to enforce issues regarding the national border and citizenship. Its not clear if a state can decide to take that up on themselves to enforce that. 2. The standards by which you identify an illegal, especially for the state of Arizona to do so. Driver's licenses aren't restricted to citizenship and we don't have things like national ID cards. Arizona itself cannot issue visas or passports and the most the state could do is have people carrying Az birth certificates but that doesn't address someone from another state to carry a birth certificate or some other proof of citizenship. The law as it stands calls for them to check with a Federal government database. Now I don't know if such database exists that list everyone in the US at any given point of time citizenship or immigration status. At the same time the Fed is under no obligation to cooperate with Az. As an individual entity the law is unenforceable on AZ's part. 3. The law is actually unneeded. Even without this law AZ law enforcement can still arrest someone under suspicion of some other crime and then turn that person over to ICE.
Let me ask you this, what traits could a person have, or what actions could a person do, that would give you a reasonable suspicion that they were an illegal immigrant? The text of the law is irrelevant if its application amounts to racial profiling.
