Alot of people seem to think that the rules state that players are allowed to actively recruit others. However in this link, there's a quote that says thats not necessarily true. Which means the Rockets could get hit with their 2nd tampering fine this month.

Here's a quote from the CBA

"(e) Any Player who, directly or indirectly, entices, induces, persuades or attempts to entice, induce, or persuade any Player, Coach, Trainer, General Manager or any other person who is under contract to any other Member of the Association to enter into negotiations for or relating to his services or negotiates or contracts for such services shall, on being charged with such tampering, be given an opportunity to answer such charges after due notice and the Commissioner shall have the power to decide whether or not the charges have been sustained; in the event his decision is that the charges have been sustained, then the Commissioner shall have the power to suspend such Player for a definite or indefinite period, or to impose a fine not exceeding $50,000, or inflict both such suspension and fine upon any such Player."

    So what says you people?

David Stern has already said there was no way to regulate this. Players will talk, regardless. Whether they're talking about their kids, the clubs, or playing with each other it's hard to stop that.

It doesn't make sense. WHat your saying is Parsons has to walk around with a bag on his head? Thats just not fair, its not his fault that just looking at him is enticing.

there's no way to regulate it because there's really no way to find out... but if the player openly says it himself, according to this rule he may just be setting himself up

It says there he has to be under contract, and right now he's a free agent, right?

Nope. Not until July 1. OP brings up an interesting point -- past they said players not fined/hit w/ charge because it is so hard to regulate or catch. But if Parsons is just openly telling people in interviews...

LeBron said he did a lot of recruiting of Ray Allen last year. I believe Kobe called Nash last season before free agency started to get him to LA. This has all been out there. As long as it's not coaches, trainers, management, or ownership there's no problem because players are friends... Friends talk about things like playing together.

    1. $50K fine? That's like half of what Parsons makes in a year!

    2. Kind of funny that the rule also covers "trainers." Are people really worried about, say, Keith Jones being enticed to leave for the Miami Heat?

    3. I think the question is how the NBA treats this rule. Does it simply ignore it all together? Or is it a matter of "Don't ask, don't tell" where players can tamper all they want as long as it is not made public? If the former, then Parsons is fine. If the latter, then he would be punished.

I think the latter case might be kind of similar to how McHale and the Wolves got into hot water for the Joe Smith contract. Other teams also made "under the table" contract promises to players-- including the Rockets, if I remember correctly, but the Wolves actually put theirs down in writing. Without writing, it's difficult to enforce the rules, but when the evidence is out there, the league had to punish the offender.

I would assume the team would go ahead and pay that for Parsons.

β€œWhat we told the owners was that the three players are totally, as our system has evolved, within their rights to talk to each other,” Commissioner David Stern said after the meeting, which was held here in conjunction with the N.B.A. summer league.

Players on different teams who discuss the idea of someday playing together β€œis not tampering or collusion that is prohibited,” Stern said.
