Having an argument with my brother about minors drinking with parents at a restaurant. I know you are legally allowed to drink with your parents at a restaurant since they are present, but if you ask and they refuse to serve you is it not within their right? My brother seems to think that they have to serve you, smh. Thoughts?
They have to serve you unless there is a certain age. If the parents order it the waiter is going to deliver unless the kid is under 14 and the parents don't look like heavy tippers.
You can deny service to whoever you want for whatever reason you want (there are some racial/religious laws but those don't apply here). This is AMerica.
The restaurant I work at doesn't allow minors to drink with their parents. There are too many ways that the restaurant could still get busted for serving a minor. If the parent gets up to use the bathroom and the drink is left on the table, the restaurant can get busted. If the drink is put in front of the minor and not in front of the parent, the restaurant can get busted. There are too many things like that, it's easier just to deny the service and avoid the risk.
The law in Texas is you can serve your child alcohol if you are present, but if you were to go to the bathroom or leave for what ever reason the server would have to take the drink away. It is up to the restaurant if they want to serve minors around their parents, most restaurants do not allow this.
