    My limited understanding of the case is that the assailant only began saying she consented once he learned she couldn't remember anything (he changed his story). His was pretty much a Cosby defense. If they are drugged or too intoxicated to remember, then you can make any claim you want about consent.

    And that him fleeing the seen of the attack is being interpreted as due to the fact he knew it was rape.

    I think that is a fair thing to do. It should be factored in along with what lasting damage does his crime do to the victim and society along with whether prison time is the primary punishment society has to counter the social and economic resources the convict may have.

    Because her being drunk does not make him *less responsible* for raping her.

    Like Reeko said, if you got robbed while drunk, would the thieves be less responsible for taking your wallet?

    However, as the judge said (which you wrongly interpreted), him being drunk did influence his own actions.

    Committing a crime when you're stone cold sober is undoubtedly more troubling an act than when you're blind drunk.

    The situation is more complicated than that. The two passersby who apprehended the defendant said that when they saw the situation unfold, he was standing up and leaving the girl who herself was completely motionless, and when they tried to intervene the defendant started running away. They had to catch him. Hardly sounds like "two black out drunk" people. Sounds like one black out drunk person and another drunk person who had enough wherewithal to make a run for it.

    Not sure what is not clear? How can two blacked out people have sex?

    For this particular case, both were intoxicated, but the convicted was clearly alert enough to ran away when caught.

    Blackout is a level on intoxication where your brain is too messed up to form memories. You seem to be thinking of passed out, or something else.

    Blacked out means being so drunk, you can't remember anything the next day. That is different from unconscious...The girl was unconscious.

    have you noticed it is always the same people.

    it's actually quite uncanny and eery how consistent they are.

    They can take almost any topic and you choose the absolute sh*ittiest worst opinion of it and right on cue that will be their stance.

    I mean I know everytime I bone behind the dumpster, I make sure to take off running right after I nut.
