Visitor visa for family member

    Anyone know much about visitor visas for family members?

    This would be for a Brazilian nephew (from my wife’s family). I know they say “close relatives”, and I don’t know if they’re going to tighten the screws during this presidency, but there seems to be a way to get a visitor’s visa for my nephew.

    Is it just a matter of speaking to the consulate? Are there lawyers or specialists well informed in this area of expertise?

    Anyone have any experience in this area, getting a visa for a family member?

    You don't need a lawyer for a simple tourist visa. The concern of the immigration officials, the reason they would reject an application, is the fear that the applicant will stay in the US and work illegally. (Or of course that he may be a terrorist or some sort of criminal.)

    Is he going to visit you? If so, write a letter addressed to the embassy that says a few brief things, mainly that your nephew plans a visit to see family and that you will provide your personal guarantee that he will not overstay his visa nor will he work. I would even give approximate dates for the proposed visit; they like that for some reason. Assure them that you have the resources to accommodate every aspect of his stay (even if he is perfectly able to do so himself). If you have a decent amount of money saved somewhere make a copy of that statement, bank statement, brokerage statement, whatever. If you earn a decent amount of money at a job make a copy of a couple of pay stubs. Make a copy of your ID. If you were born in the US I would recommend a copy of your passport. If you weren't I would recommend a brief explanation of your situation (immigrated to the US at X age, green card holder, naturalized in year Y, you know, whatever).

    Send all this down to him for him to present at his interview. I would be very surprised if he were rejected unless he'd been rejected before for some other reason.
