    WASHINGTON (AP) — The official sign-up season for President Barack Obama's health care law may be over, but leading congressional Democrats say millions of Americans facing new tax penalties deserve a second chance.
    Three senior House members told The Associated Press that they plan to strongly urge the administration to grant a special sign-up opportunity for uninsured taxpayers who will be facing fines under the law for the first time this year.
    The three are Michigan's Sander Levin, the ranking Democrat on the Ways and Means Committee, and Democratic Reps. Jim McDermott of Washington, and Lloyd Doggett of Texas. All worked to help steer Obama's law through rancorous congressional debates from 2009-2010.
    The lawmakers say they are concerned that many of their constituents will find out about the penalties after it's already too late for them to sign up for coverage, since open enrollment ended Sunday.
    That means they could wind up uninsured for another year, only to owe substantially higher fines in 2016. The fines are collected through the income tax system.
    This year is the first time ordinary Americans will experience the complicated interactions between the health care law and taxes. Based on congressional analysis, tax preparation giant H&R Block says roughly 4 million uninsured people will pay penalties.

    That's stupid.

    I do wish they would make changes to the enrollment platform but just creating one because you don't want your constituents to get mad they had to pay a tax is weak.

    Politicians are terrified of being responsible form taxes. It's a linguistic MMA when it comes to twisting and turning away from getting pinned with the term.

    Except in this case, the tax levied would likely be cheaper than getting a plan.

    This has been one of the most contested pieces of legislation since the Patriot Act (maybe). How are congressional representatives now coming around to the realization that the ACA will penalize people without qualified insurance plans? Their constituents must not read the news - at all...ever. That being said there certainly will be people, who while filing their income tax, realize that the refund they expect to get will not be as big or there.

    Best part is, the government will remember if you owed and were not due a refund. So, even if you owe money on the return, the government will remember for the next 10 years. So, if you expect a return in 2020 and though you were smooth by avoiding the penalty, think again.

    Well the democrats did everything they possibly could to minimize the publicity around the tax, so I'm not entirely surprised. Plus we're dealing with a lot of low information voters, as well.

    The only good thing about is that this turd of a law will forever reflect on Obama and the Democrat party. Other than the idiot John Roberts (in a round-a-bout way), no Republican voted for it. It cost them big time in the last election and it will only get worse as the uninformed people start to realize the truth.

    You don't exactly have a good track record on predicting well... That whole end of the world prediction and Mitt Romney in 2012 thing really... Well didn't pan out. Best of luck on this one I guess.

    I guess I am a little confused on this topic. My understanding is that if you signed up for insurance or dropped insurance during the year, you paid a prorated fine (tax) for the time you didnt have coverage.
    Im I understanding that if you do not sign up for insurance by a set date... and if you're 1 day late, you pay the entire fine (tax) ?

    This isn't some sort of new realization...at least for members of congress. This is basically a "Sorry, I got your back bra" for the constituents. If they legitimately didn't know, sure I guess they should have some sort of second chance..but really too bad.

    You have to pay for the tax in order to find out how much it costs.

    There's no better way to really learn about the penalty than paying it. If 4 million people pay the penalty this year, they'll make a better informed choice next year.

    I believe the administration is looking at some type of offer to those who genuinely did not know the tax was coming. Offering a short window to register for a plan if they so choose.

    The penalty is clear. There is no prorated fee.

    https://www.healthcare.gov/fees-exemptions/fee-for-not-being-covered/

    There are exemptions (such as short coverage gap, certain income level, affordability,...)

    If you get dropped and then you picked up new ins in less than 3M, you are exempt from the fee.

    It sounds like as long as you don't have coverage that last for more than 3 consecutive months, you can be exempt, but I didn't read the details to figure that out.

    As for "relief" from the fee... the system already have exemptions for those that they thought would need it. Not knowing is unfortunate, but what's the point of a penalty if there is no penalty.
