You do realize that a BAC of .126 will cause you to be slower at hitting the brake, right? A half a second delay in hitting the brake can be the difference between stopping and hitting the guy. I reject the notion that the result would likely have been the same. There is no way to know that. What we do know is that he got 30 days for a charge that any of us on this board would be looking at 10 to 15 years for.
