Sounds pretty cut n dry, but this type of Treason does not appear to be punishable by death. The Logan Act states a fine and up to 3 yrs in prison. I think the treason you are talking about would be military personnel, not civilians.
i'm not sure it's proven, but if true, almost certainly a Logan act violation. IIRC, John Kerry may have likewise violated the Logan act in 2004, and Obama in 2008, although the latter case is less clear. politics, especially in time of war, used to stop at water's edge.
