The charges are bizarre - but that woman deserves serious jail time.

Manipulating a 13 yr old girl that you know is suffering from self-esteem for months, and then urging her to commit suicide should be a murder charge.

I wouldn't worry about it unless you plan on manipulating and playing with minors on sites.

you guys seriously don't think this is an overreaching of the law? whether or not the woman deserves to serve jail time is irrelevant. if this goes through the precedent set will have a huge impact on the ability of people to communicate on the web.

the proper charge imo would have been criminal harassment using electronic means. not as much jail time maybe, but think about this - if the charge goes through, the court will have to be very careful or we will basically have to shut down posting with aliases.

Isn't because they violated the "user agreement" when they electronically signed it by clicking the "I agree" button? It's okay to post with aliases as long as you're not breaking the rules of the site right? So it's basically contractual law thing imo. Always read before you sign (or click).

i thought the TOS was only useful in a civil suit...this seems to be a criminal case not involving myspace at all (except as the "crime scene" i suppose)

Interesting case. All the federal computer crime statutes are written so vague that you could just about prosecute anything under them. In fact, that's pretty much the story on the entire federal penal code. Broad discretion for prosecutors.

I sure like how when something distressing happens the law is quick to protect their incumbency..I mean people.

That sure is noble. And besides, only criminals are concerned with privacy. Obviously, there's no reason for anonymity on the internet other than to exploit children.
