    2nd degree murder does require intent. It means they have enough evidence to show it wasn't accidental

    No it doesn't. There can be intent, but isn't required (the alternative being a disregard for human life or happening during the commission if a crime). These are the Texas Murder statutes that don't require intent to kill:

    2) intends to cause serious bodily injury and commits an act clearly dangerous to human life that causes the death of an individual

    (3) commits or attempts to commit a felony, other than manslaughter, and in the course of and in furtherance of the commission or attempt, or in immediate flight from the commission or attempt, he commits or attempts to commit an act clearly dangerous to human life that causes the death of an individual.
    Whether or not she will be found guilty of murder or not is a different question, but the new DA is handling the case like they would if she want a cop.

    First, I don't even think Texas has a 2nd degree murder charge. 2nd, the DA disagrees with you - so perhaps you can explain why the DA is wrong?

    Doesn't sound like it was reckless behavior, sounds like it was murder and she knew she was commiting a crime in murdering him.

    Texas doesn't, but their regular murder charge is similar. And he isn't disagreeing with me, he is giving his reasoning. I gave you the verbatim law from the Texas Penal Code. Is that not an adequate source for you?

    You said in this case it was reckless behavior and not intentional, the DA (a woman by the way) said it was "intentional and knowing"

    Sounds like she is in fact disagreeing.

    She never mentions her job. The audio imo rules out any conspiracy. She called 9-11 and was really honest about shooting someone unless there was some hidden motive and the call is an act

    Just a really stupid situation

    The state fair they reference lasts 23 days. So, I'm not sure why a delay should by 60-90 days. A 60 day delay would put it at Thanksgiving. A 90-day delay at Christmas. I could see setting it for Oct 21, the day after the state fair, if they bother at all. But if there is any rioting, it won't be until the verdict is reached anyway.
