Got hit by another car am I covered by their policy?

    So, about a moth ago, my truck was parked at work and a car hits it. The policy holder is a customer of mine but his son/nephew was the one driving. I call for a police report and get the other cars insurance information.

    Fast forward to today, I call their insurance agency and want to know whats going on on the claim and why I havent gotten paid yet. They tell me that their research is still pending cause they need a testimony from the driver(son/nephew) and the policy holder before they can issue payment. They also low balled my on an estimate.

    I have the truck in a body shop currently and am being told that its incurring a $35/day holding fee if not picked up. The cost of repair was significantly more and I tell that to their insurance agency and they respond with the same respons, "until the testimony, we can not provide payment" and to add to that they said "we arent responsible for the storage fee, it is yours as a car owner".

    What the hell do I do in this situation? I can pay for it out of pocket but dont want to, on principle.

    Edit: Filed with Geico, my insurance, and was told that after the deductible, they would fight for reimbursement from the other company but it could be a period of time and was not guaranteed. Very hassle free.

    The name of the suspect insurance agency is Falcon Insurance Company. **** them.

    Ugh. My input is not going to be helpful, but I have heard over and over that any parking lot is an evil gray zone for traffic law and insurance claims. If yours vanishes into a steaming crevasse opening onto the hellsphere, it would not be the first. I wish I knew what to advise.

    Just claim it on your own policy and get them to deal with it. They have a subrogation department to handle this kind of stuff. Its good you have a police report, but it might take a while. Otherwise the other party will just drag their feet.

    File a claim with your insurance company. Don't worry ofc they will not pay it, but they will get his moving.

    Yes claims on private property suck... Did the police come out, assign fault?

    Agree with those saying to notify your insurance company and get them to take their knives out because they won't want to pay.

    Dont know if they assigned fault but I would assume so. Also, its pretty evident since I was a parked car with nobody in it, I would think.

    I'd never assume anything when it comes to insurance claims.
    If you have a good insurance company, I'd say make the claim with your insurance and let them know to open up a claim against the other party's insurance company. Give all the details to your insurance company (police claim #, witnesses, your story, etc). You will have to foot the deductible bill until your insurance can settle with them.

    Basically let the insurance companies fight it out saving you the time and grief of having to deal with it.

    Had a similar situation with being rear ended on 35 where it was the driver behind me at fault. I got a police report and get the driver's insurance information. The driver dragged his feet and dodged his own insurance's phone calls to the very end until his own insurance reported he would be liable for cost of repairs to my vehicle if the driver did not cooperate with their own internal investigation on who was at fault. This dragged on for months but eventually I got my rear cameras fixed as well as the bumper without being charged for cost of repair.

    My understanding is, if I did opt to repair it on my own before their investigation concluded, the driver at fault's insurance company would have been liable for paying for my cost of repairs if they concluded it was their client responsible for the collision.

    I was Tboned by somebody running a red light last year. I just filed everything with my insurance and they took care of going after the other insurance company. It was pretty straightforward.

    I do have comprehensive/collision insurance, so my guess is that you don't have the same options if all you have is liability.

    yea i remember my car got hit while i wasn't there. after i drove back to my apartment i realized the dent, but after you move your car it isn't covered anymore.

    Sounds like you’re about to be out your deductible with no reimbursement coming. They don’t want to pay. This testimony bs may never happen. Falcon insurance? WTF?

    First thing you need to do is get your truck back and stop getting storage added on to the bill.

    If the son/nephew is not on the owners insurance or does not have insurance of their own you are screwed. If the insurance does not pay. Give the bill to owner or kids parent. Tell them to pay up.

    Update: The other owners insurance finally called me and told me I as NOT covered cause the driver at the incident was not listed on the policy. I promptly told him to "go **** yourself and that my insurance is gonna come after my deductible" and then hung up.

    I'm not an insurance guy, but I always thought the car was covered regardless of who was driving.

    I had a kid hit my truck one time and the mother pleaded with me to lie and say that she was driving so they’d be covered. I was pretty conflicted because I didn’t want it to come back on me but I felt bad for her and said she was driving. I was in a friends house and my truck was parked out front. The kid came and knocked on the door and fessed up which I found to be a sign that she’d done a good job raising him.
