Obviously this is a complex issue and overall I tend to agree that addressing this on a federal level through an EO is a too blunt of an instrument to address it. I fully agree that this should have gone through Congress and it was an another example of Obama using EO to get around Congress. All of that said the mechanism of the AFFH is through HUD funding and in this case as like using Federal highway funds to compel states to institute a 21 year drinking age is a well established practice. Heck Trump is just now using that same principle to threaten school districts to reopen, which is a local issue, by threatening to withhold Federal education funding. On whether this fits the FHA there is nothing in the FHA that states whether addressing income disparity is allowed and how that is done. According to the commentary of the some of the authors of the bill the FHA certainly does intend to address economic disparity so this is within the spirit of the Act while the letter is essentially neutral on it.

That would be totally fine right?
