Interesting topic. In the midst of dealing with these legal questions where I work. We are still conducting probable cause hearings (constitutionally required within 48 hours of an arrest) every morning. However, all jury trials are postponed indefinitely. Only “essential” hearings are being held; child custody, involuntary mental commitments, etc. But everything else is on hold. I think the PC hearings are a bedrock fundamental right that musn’t be altered.
The PRC turned the corner doing things flying drones around Wuhan to spot people out on the street and then forcibly taking them into custody. In many cases they didn't just send them home but put them into wards for those infected. I fear we might be headed there but also I can't imagine all Americans putting up with things like that even if it is for stopping the disease.
Let's remember Lincoln suspended Habeus Corpus during the civil war. FDR detained Japanese Americans with no due process. Fundamentals can and have been altered. I'm not saying that we should or that is right but that just that it is very much possible we could come to that state.
The best way to deal with this is simply not to arrest non-violent offenders, particularly drug offenses that barely rise to felony level. Police departments are being advised to prioritize arrest so we can avoid overcrowding
